PROCEEDINGS OF THE BEADLE COUNTY COMMISSIONERS

JANUARY 3, 2006

      The Board of Beadle County Commissioners met Tuesday – January 3, 2006 at 10:00 a.m., pursuant to adjournment of December 30, 2005 with members present: Chairman Dahl, Vice Chairman Mattke, Chase, Marcus and Ziegeldorf.       

    Chairman Dahl having determined the business for 2005 to have been completed adjourned at 10:40 a.m. - sine die.

    Chairman Dahl called for nominations for 2006 Chairman. Commissioner Chase nominated Commissioner Mattke.

      Moved by Chase, seconded by Marcus. Motion carried. To close nominations and instruct the Auditor to cast unanimous vote for Commissioner Mattke as Chairman.

      Chairman Dahl called for nominations for 2006 Vice Chairman. Commissioner Ziegeldorf nominated Commissioner Chase.

     Moved by Ziegeldorf, seconded by Marcus. Motion carried. To close nominations and instruct the Auditor to cast unanimous vote for Commissioner Chase as Vice Chairman.

      Commissioner Mattke Chaired the remainder of the meeting with all members present.

      Chairman Mattke called for motion to reappoint James Schmidt as custodian for 2006. Motion called for three times. Dies for lack of motion.

      Moved by Ziegeldorf, seconded by Chase. Motion carried. To approve to advertise for a Custodian position to close January 24, 2006 and to table custodian appointment until January 31, 2006.

      Moved by Marcus, seconded by Chase. Motion carried. To approve for James Schmidt to receive pay and insurance coverage through January 31, 2006 and receive pay for earned and unused vacation hours.

      Moved by Ziegeldorf, seconded by Dahl. To approve Resolution 01-01-06 to relieve Mike Johnson from his duties as Beadle County Highway Superintendent effective January 3, 2006 per SDCL 31-11-1; with 30 days pay and insurance coverage. Mr. Johnson will also be paid for any unused and earned vacation.

RESOLUTION 01-01-06

      BE IT RESOLVED: That Mike Johnson was appointed Beadle County Highway Superintendent by the Beadle County Commission under the authority granted to it in SDCL 31-11-1; said appointment took effect January 1, 2005 and was to end December 31, 2006. At the time of the appointment Mike Johnson signed an agreement of appointment to said position.

     IT IS FURTHER RESOLVED: That under the authority granted to the Beadle County Commission in SDCL 31-11-1 which states in pertinent part “The tenure of office of the county highway superintendent may be terminated at any time by resolution of the board of county commissioners upon thirty days notice…” the Beadle County Commission has the right to terminate Mike Johnson at any time with 30 days notice; therefore,

      WE, HEREBY RESOLVE: That on this 3^rd day of January 2006, Mike Johnson will be terminated from the position of Beadle County Highway Superintendent effective February 3, 2006.

      Chairman Mattke called for a Roll Call vote

     Marcus         Yes

     Ziegeldorf     Yes

     Mattke          No            Motion carried.

     Moved by Marcus, seconded by Dahl. Motion carried. To approve to hire Erv Huber as interim Beadle County Highway Superintendent effective January 4, 2006 at $17.00 per hour.

      The Board worked on General Policies for 2006.

      On motion the Board adjourned to meet next on – January 10, 2006 at 10:00 a.m.
