PROCEEDINGS OF THE BEADLE COUNTY COMMISSION

FEBRUARY 14, 2006

      The Board of Beadle County Commissioners met Tuesday – February 14, 2006 at 10:00 a.m., pursuant to adjournment of February 7, 2006 with members present: Chairman Mattke, Vice Chairman Chase, Dahl and Ziegeldorf. Absent: Marcus.

     The minutes of February 7, 2006 were approved as read with no additions or changes.

      Mike Weaver and Vince Juelfs from Huron City met with the Board to discuss establishment of a Construction and Demolition Site on an abandoned lime, sludge facility owned by the City. (NW4 of NW4 Section 8, Custer Township)

      Moved by Chase, seconded by Dahl. Motion carried. To adopt the following resolution:

Resolution No 02-04-06

County Commission

 WHEREAS, the City of Huron desires to establish a C & D Site on an abandoned lime sludge facility for the purpose of solid waste management; and

WHEREAS, the City of Huron has approved siting the proposed facility; and

WHEREAS, the siting of this proposed facility is not in conflict with any established zoning laws or ordinances; and WHEREAS, City of Huron will file a Solid Waste Application with the South Dakota Department of Environment and Natural Resources (SD DENR); and

WHEREAS, DENR will review that application to determine that the facility can be operated within the South Dakota laws and regulations; and

WHEREAS, DENR will recommended the approval of the permit with conditions adequate to safeguard the environment; and

WHEREAS, the Board of Minerals and Environment will review, modify, approve, or deny the permit if the tentative recommendations and/or conditions of the permit are contested by any interested party; and

WHEREAS, the County Commission of Beadle County is required by South Dakota law SDCL 34A-6-103 to approve a Solid Waste Facility prior to the issuance of a solid waste permit;

IT IS THEREFORE RESOLVED that the County Commission of Beadle County hereby approves construction and operation of the proposed facility to be operated under the terms of a Solid Waste Permit to be issued by the Board of Minerals and Environment.

     Bill Paulson and Ken Peterson from Heartland Grain Fuels and Brad Sibson of SD Wheat Growers met with the board to present a Conditional Use Permit application for SD Wheat Growers to conduct a grain handling & grain drying operation in an area zoned I-2 General Industrial (Gilbert OTL #1 a part of the E2 of the SE4 less Lot H-1 and Mies OTL 1 Section 34, Theresa Township).

      Moved by Dahl, seconded by Ziegeldorf. Motion carried. To approve Conditional Use Permit for SD Wheat Growers to conduct a grain handling and grain drying operation in an area zoned 1-2 General Industrial. (Gilbert OTL 1 a part of the E2 of the SE4 less Lot H-1 and Mies OTL 1, Section 34, Theresa Township).

      Moved by Chase, seconded by Dahl. Motion carried. To approve variance request of Peanotz Inc (NE4, Section 3, Barrett Township) to operate a facility to roast soybeans, sunflowers or barley products in an area zoned agricultural.

      Moved by Ziegeldorf, seconded by Dahl. Motion carried. To adopt the following resolution:

RESOLUTION 02-05-06

“PLAT OF GLANZER LOT 1, A PART OF THE NW4

OF SECTION 33-112-60”

     On recommendation of the Beadle County Planning Commission: BE IT  RESOLVED:  by the Board of Beadle County Commissioners that the plat of “Glanzer Lot 1, a part of the NW4 of Section 33-112-60”, West of the 5^th P.M., Beadle County, South Dakota, as described above and drawn hereon be approved and accepted and the Auditor hereby is instructed to endorse on such plat a copy of this resolution and to certify the same.

      Moved by Ziegeldorf, seconded by Chase. Motion carried. To approve extension of Conditional Use Permit of Ka-Boomers Enterprise, Inc at 39650 Highway 14, Huron to operate a fireworks stand on property owned by Wayne Yauney.

      Moved by Dahl, seconded by Chase. Motion carried. To approve a Quit Claim deed to Kim Puterbaugh from Beadle County 8’  lake access Lot 13, McNiders Addition to Lake Byron.

      On motion the Board adjourned to meet next on February 28, 2006 at 9:30 a.m.
