PROCEEDINGS OF THE BEADLE COUNTY COMMISSIONERS
APRIL 18, 2006


The Board of Beadle County Commissioners met Tuesday – April 18, 2006 at 10:00 a.m., pursuant to adjournment of April 11, 2006 with members present: Chairman Mattke, Vice Chairman Chase, Dahl, Marcus and Ziegeldorf.


Moved by Dahl, seconded by Ziegeldorf. Motion carried. To approve to declare 19,500 lbs of miscellaneous scrap metal as surplus and sold to Barti Metal for $504.90.


Moved by Marcus, seconded by Dahl. Motion carried. To approve variance request of Lorne W Neill to move a manufactured home onto two 1 acre lots where residence is not permitted, with stipulation that a passing peculation test is provided and required setbacks are met. (Legal – Krapf Smith Outlot & Krapf-Opsahl Tract #1 SE4, Section 33, Valley Township, Record #3543)


Moved by Chase, seconded by Marcus. Motion carried. To approve Conditional Use Permit for a cattle feed lot for 999 animal units submitted by Ken Hofer. (Legal SE4, Section 22, Pleasant View Township Record #6405) No one appeared in opposition of this application.


Moved by Dahl, seconded by Ziegeldorf. Motion carried. To adopt the following resolution:


RESOLUTION 04-04-06
“PLAT OF KOZIOLEK LOT 1, A PART OF THE SE4 
OF SECTION 24-110-59”

On recommendation of the Beadle County Planning Commission: BE IT RESOLVED: by the Board of Beadle County Commissioners that the plat of “Koziolek Lot 1, a part of the SE4 of Section 24-110-59”, West of the 5th P.M.,
Beadle County, South Dakota, as described above and drawn hereon be approved and accepted and the Auditor hereby is instructed to endorse on such plat a copy of this resolution and to certify the same.

RESOLUTION 04-05-06
“PLAT OF GARBE OUTLOT 1, A PART OF THE SE4

On recommendation of the Beadle County Planning Commission: BE IT RESOLVED: by the Board of Beadle County Commissioners that the plat of “Garbe Outlot 1, a part of the SE4 of Section 17-109-63”, West of the 5th P.M., 
Beadle County, South Dakota, as described above and drawn hereon be approved and accepted and the Auditor hereby is instructed to endorse on such plat a copy of this resolution and to certify the same.

RESOLUTION 04-06-06
“PLAT OF BOBBI JO ACRES, A PART OF THE SE4 
OF SECTION 10-111-62” 

On recommendation of the Beadle County Planning Commission: BE IT RESOLVED: by the Board of Beadle County Commissioners that the plat of “Bobbi Jo Acres, a part of the SE4 of Section 10-111-62, West of the 5th P.M., 
Beadle County, South Dakota, as described above and drawn hereon be approved and accepted and the Auditor hereby is instructed to endorse on such plat a copy of this resolution and to certify the same.


Moved by Dahl, seconded by Chase. Motion carried. To approve Abatement of $100.00 weed tax for the City of Huron on Airport Lot H, 36-111-62, Theresa Township (Record #3920) as was certified to wrong land owner.









At 10:45 a.m. Chairman Mattke opened Public Hearing for Conditional Use Permit for Heartland Pork LLC to start a 1500 sow farrow to wean unit. (Legal SE4 of NE4, Section 33, Carlyle Township)
Dave Uttecht and Mike Kopfmann represented Heartland Pork LLC. Mr. Uttecht explained their plan would exceed county regulations and are working with Dakota Environmental for a State Permit even though a state permit is not needed for 999 animal unit. The project will have pits under the buildings and no lagoons. This is being constructed behind an already mature and well developed tree strip. With new designs in barns and controlled diets, odors have been reduced. Waste from the pits will be injected and then disked into the ground. Will have 1500 sows on site 365 days a year. The operation will have 5 local employees and feed will be purchased at local level.

Todd Koerner, landowner in Carlyle Township asked where the young pigs going when weaned, why should he as a landowner suffer from odors caused by this operation and he felt his property value would decrease. Mr. Uttecht stated they would not secured place for the young pigs until permits had been approved. The odor should be controlled with diet and new design of buildings with under ground pits.

Larry Neuharth, Carlyle Township landowner, asked how many sows & young pigs would be there during a year’s time. He also had concerns with smell. Mr. Uttecht stated there would be 1500 sows there 365 days a year and approximately 30,000 young pigs would be born here in a year.

Buzz Kutzler, Chairman of the Beadle County Planning Board, stated he had phone calls from Doug Jones, area landowners, and Jim Abourezk asking for delay so additional information could be presented.

Verna Koerner, Carlyle Township landowner, also had concerns with smell and ammonia; not good for health or the ground.

Mike Kopfmann stated wastes would be injected under state guidelines.

Leo Koerner, Carlyle Township landowner, had concerns with odor.

Terry Koerner, Carlyle Township landowner, had concerns with on going odor and someday would like to retire here.

Dave Uttecht explained that keeping hogs in state, buying feed from local farmers, employees from local area and about tax dollars for local townships would be an asset from the company.

Chairman Mattke suggested the board delay action on this Conditional Use Permit for further study.

Commissioner Chase felt there had been good input during the Beadle County Planning meeting and during this hearing that it should not be delayed. Planning Commission had recommended approval.

Moved by Dahl, seconded by Marcus. Motion carried. To approve Conditional Use Permit for Heartland Pork LLC to construct a 1500 sow farrow to wean unit on the SE4 of the NE4, Section 33, Carlyle Township.

Moved by Chase, seconded by Marcus. Motion carried. To approve Conditional Use Permit for Dale and Sandy Gilyard to start a 399 animal unit to feed calves from 200 to 600 pounds on Gilyard Outlot in the N2 of Section 23, Dearborn Township. They have signed agreements with Warren Schrader, Stuart Neuharth and Robert Riley in Dearborn Township to spread manure. No one appeared in opposition of this application.

Moved by Ziegeldorf, seconded by Marcus. Motion carried. To approve application for buried cable from Qwest Corporation to bore under County Highway #12 (199th Street) in the NE4 of Section 21, Iowa Township.

Moved by Chase, seconded by Dahl. Motion carried. To approve to renew Intergovernmental Agreement with the City of Huron for the purpose of sharing 911 telephone emergency call services with an effective date of June 1st 2006. County will pay 40% of 1 dispatcher’s expenses.

Moved by Marcus, seconded by Chase. Motion carried. To go into Executive Session at 1:15 p.m. to discuss personnel matters. Chairman Mattke declared Executive Session over at 1:45 p.m.
