PROCEEDINGS OF THE BEADLE COUNTY COMMISSION
MAY 9, 2006
The Board of Beadle County Commissioners met Tuesday – May 9, 2006 at 10:00 a.m., pursuant to adjournment of April 27, 2006 with members present: Chairman Mattke, Vice Chairman Chase, Dahl, Marcus and Ziegeldorf.
The minutes of April 27, 2006 were approved as read with no additions or changes.
Moved by Chase, seconded by Dahl. Motion carried. To approve to set date of May 23, 2006 at 11:00 a.m. for the public hearing on renewal of Malt Beverage licenses for 2006-2007. (Cain Creek & DJ’s Travel Center)
Moved by Chase, seconded by Marcus. Motion carried. To approve Intergovernmental Agreement between Huron City and Beadle County as presented by Chief Doug Schmitt and Beadle County Sheriff Tom Beerman for the purpose of sharing 911 telephone emergency call services.
Moved by Ziegeldorf, seconded by Marcus. Motion carried. To approve to hire Judy Rodacker as clerk in the Register of Deeds Office effective date June 1, 2006.
Moved by Ziegeldorf, seconded by Marcus. Motion carried. To approve to go into Executive Session at 10:35 a.m. to discuss personnel matters. Chairman Mattke declared Executive Session over at 11:05 a.m.
At 11:05 a.m. Chairman Mattke reopened Public Hearing for Alcoholic Beverage License requested by Burke Trucking.
Chairman Mattke asked if there were any additional comments.
Donn Burke, Burke Trucking, presented petitions in favor of the license. Petitions were signed for 400 petitioners.
Commissioner Marcus felt that this needs to be taken to the planning board to request a variance as property is not zoned for running a bar or camp ground.
Donn suggested that date be set by the Board to be open only during the event.
Mike Moore, Beadle County States Attorney, said that under SDCL 7-8-20(8) the commission could set the dates.
Bill Eining stated that he attended the event in 2005 and had a good time and felt it was well run.
Regela Walz presented additional letters signed by Belle Prairie, Banner, Dearborn, Iowa and Vernon Townships that are against alcoholic Beverage Licensing in Townships.
Commissioner Marcus asked why alcohol was served at last year’s event when application was only for malt beverage license.
Donn Burke stated all forms looked alike and was not aware it was only for malt beverage.
Moved by Dahl, seconded by Chase. Motion carried. To approve to deny Alcoholic Beverage License request of Burke Trucking on Pioneer Tract 1A, a part of the NW4 of Section 11-110-60 Richland Township.
Moved by Ziegeldorf, seconded by Marcus. To approve Street Maintenance Agreements for Hitchcock, Cavour and Yale Towns.
Moved by Marcus, seconded by Dahl. Motion carried. To declare 467 lbs of aluminum as surplus and sold to Barti Metal for $140.10.
Moved by Ziegeldorf, seconded by Chase. To approve the following Township Bonds.

Moved by Marcus, seconded by Chase. Motion carried. To declare video chairs from Juvenile Detention Center as surplus and to sell for $20.00 plus tax.
Moved by Chase, seconded by Ziegeldorf. Motion carried. To approve to rent from Sheehan Mack Sales on 4 double drum smooth drum roller for 4 months in the amount of $1,600.00 per month.
The Board adjourned to meet next on May 16, 2006 at 9:00 a.m.
