PROCEEDINGS OF THE BEADLE COUNTY COMMISSION
JULY 11, 2006

The Board of Beadle County Commissioners met Tuesday July 11, 2006 pursuant to adjournment of June 29, 2006 with members present: Chairman Mattke, Vice Chairman Chase, Dahl, Marcus and Ziegeldorf.


The minutes of June 29, 2006 were approved as read with no additions or changes.


At 11:00 a.m. the Beadle County Surplus Land Sale was held.


Moved by Marcus, seconded by Chase. Motion carried. To adopt the following resolution:

RESOLUTION 07-01-06
“GRANT SUPPLEMENTAL BUDGET”

WHEREAS, unanticipated reimbursements were received from the State of South Dakota Department of Public Safety Office of Homeland Security for 2005 Homeland Security ODP 2005 Training Grants. The following item will be reimbursed for monies expended in the 2006 Budget.

226 222.429.04 Emerg Mgmt Homeland Security $4,044.72

NOW, THEREFORE, BE IT RESOLVED: that the Board of Beadle County Commissioners do hereby propose, make and move for adoption of this Grant Supplemental Budget in the items set forth above.


Moved by Chase, seconded by Dahl. Motion carried. To adopt the following resolution:

RESOLUTION 07-04-06
“DECLARE A FIRE DANGER EMERGENCY
IN BEADLE COUNTY AND TO
PROHIBIT OPEN BURNING”

WHEREAS, due to extreme dry conditions in Beadle County a fire danger emergency within Beadle County, South Dakota, now,
THEREFORE BE IT RESOLVED: by the Beadle County Board of Commissioners that a fire danger emergency is hereby declared, and until this resolution be otherwise rescinded by the Beadle County Board of Commissioners. Open burning shall be prohibited within any or all of the unincorporated area of Beadle County. Burn barrels and camp fires will be permitted but proceed with caution.
THEREFORE BE IT RESOLVED: that per SDCL 34-35-12 a person who sets a fire as provided in SDCL 34-35-10 is liable for civil damages for all injury and fire suppression and extinguishment costs caused by the fire, and
BE IT FURTHERER RESOLVED: that this resolution is declared to be necessary for the immediate preservation of the public safety with in the provision of SDCL 7-18A-8 and is effective immediately and shall continue in force and effect until rescinded by the Beadle County Board of Commissioner and,
BE IT FURTHERER RESOLVED: that a fine not to exceed two hundred dollars for each violation, or by imprisonment for a period not to exceed thirty days for each violation, or by both the fine and imprisonment, if found in violation of this resolution, as per SDCL 7-18A-2.

Moved by Ziegeldorf, seconded by Dahl. Motion carried. To adopt the following resolution:

RESOLUTION 07-02-06
“RECONVEYANCE”

WHEREAS, the Tax Deed to the following described real property to-wit: South Fourteen Feet (S14’), of Lot Two (2), and North Thirty-Six Feet (N36’) of Lot Three (3), Block Thirty-Four (34),4th Railway Addition, City of Huron, Beadle County, South Dakota, was taken for unpaid taxes, and,
WHEREAS, the record owners therefore paid Beadle County Treasurer all taxes, interest and cost represented in such years,
NOW, THEREFORE, BE IT RESOLVED: That the above described real property shall be reconveyed to Doug Songer the owner of record therefore in the manner as provided by SDCL 10-25-41, after the time for appeal for such resolution has expired.




Moved by Dahl, seconded by Marcus. Motion carried. To adopt the following resolution:

RESOLUTION 07-03-06
“PARTIAL RELEASE OF COUNTY AID LIENS”

The following described real property is hereby released from the lien of that certain County Aid Lien held by Beadle County against Kathy Trujillo and Steven Trujillo which has a present balance of $435.00:

Lot 7 & 8 and the North 5 feet of Lot 9, Block 1, County Auditor’s Plat No. 2, to the town (now City) of Huron, Beadle County, South Dakota

The lien of said County Aid Lien shall continue as to all other real property of Kathy Trujillo and Steven Trujillo in the State of South Dakota.


Moved by Marcus, seconded by Ziegeldorf. Motion carried. To approve for Heartland Collections Inc to work with Deputy Skip McWethy, Jail Administrator in collections of prisoner accounts.


On motion the Board adjourned to meet next on Tuesday – July 18, 2006 at 9:00 a.m.
