The Board of Beadle County Commissioners met Thursday – May 31, 2007 at 9:00 a.m., pursuant to adjournment of May 15, 2007 with members present: Chairman Mattke, Vice Chair Marcus, Chase, Drake and Werner. 


The minutes of May 15, 2007 were approved as read with no additions or changes.

On recommendation of the Beadle County Planning Commission: BE IT RESOLVED: by the Board of Beadle County Commissioners that the plat of “Shoemaker Outlot located in the E2 of the NE4 of Section 8-110-64”, West of the 5th P.M., Beadle County, South Dakota, as described above and drawn hereon be approved and accepted and the Auditor hereby is instructed to endorse on such plat a copy of this resolution and to certify the same.

On recommendation of the Beadle County Planning Commission: BE IT RESOLVED: by the Board of Beadle County Commissioners that the plat of “Huizenga Lot 1, a part of the SW4 of Section 22-113-63, West of the 5th P.M., Beadle County, South Dakota, as described above and drawn hereon be approved and accepted and the Auditor hereby is instructed to endorse on 
such plat a copy of this resolution and to certify the same. 

Declaration of Restrictive Covenants and are the owners of the hereinafter described real property. That to comply with Beadle County codes in regards to minimum yard setbacks. Beadle County, South Dakota, hereby makes the following declaration restricting the platting and future construction on and the use of the hereinafter described property.

That in connection with:
a) the lots described as Huizenga Lots 1 a part of the southwest quarter 22-113-63 and Huizenga Lot 2 a part of the northwest quarter 22-113-63 (Altoona Township)

Said property described in “a” above shall hereinafter be considered a single “lot” according to section 706 – minimum yard setbacks, Beadle County, South Dakota.

On recommendation of the Beadle County Planning Commission: BE IT RESOLVED; by the Board of Beadle County Commissioners that the plat of “Weidner Lot 1, a part of the NE4 of Section 13-112-60”, West of the 5th P.M., Beadle County, South Dakota, as described above and drawn hereon be approved and accepted and the Auditor hereby is instructed to endorse on such 
plat a copy of this resolution and to certify the same.


Moved by Drake, seconded by Marcus. Motion carried. To approve buried cable applications from Qwest for Section 23-111-62 (Theresa Township) along 205th St and Section 15-113-61 (Lake Byron Township) along 404th Avenue.


At 11:00 a.m. the Chairman announced the time for the Public Hearing on the On-Off Sale Retailer Malt Beverage Licenses for the 2007-2008 Licensing Period (effective July 1, 2007 through June 30, 2008) and Off-Sale Package Malt Beverage License for the 2007-2008 Licensing Period (effective July 1, 2007 through June 30, 2008) Received applications from DJ’s Travel Center and Fowl Play Inc.


Moved by Drake, seconded by Marcus. Motion carried. To approve the 2007-2008 On-Off Sale Retailer Malt Beverage License to Fowl Play Inc. and 2007-2008 Retail Off-Sale Package Malt Beverage License to DJ’s Travel Center LLC.

Moved by Marcus, seconded by Chase. Motion carried. To go into Executive Session at 11:14 a.m. to discuss personnel matters. Chairman Mattke declared Executive Session over at 11:45 a.m.

Moved by Drake, seconded by Werner. Motion carried. To deny variance request of Rita Goehring to place a detached garage 4’ from west property line and 5’ from the south (roadside) property line where code requires roadside at 15’ and side yard at 7’. Legal E’2 of Lot 12, All of Lot 13, Willard & Ellen Tschetter Addition to Lake Byron.

Moved by Werner, seconded by Chase. Motion carried. To approve renewed application for General Permit for Petroleum contaminated soil land farm by Shawn Thelen in the SW4, Section 9-111-61 Valley Township.

Moved by Werner, seconded Chase. Motion carried. To go into Executive Session at 12:35 p.m. to discuss contract. Adjourn at 12:55 p.m. Continue at 1:30 p.m. Chairman Mattke declared Executive Session over at 1:45 p.m.

Mike Moore, Beadle County States Attorney and Ellen Kuhler, summer intern met with the Board to review drainage laws.

Moved by Chase, seconded by Marcus. Motion carried. To go into Executive Session at 2:55 p.m. to discuss personnel matters. Chairman Mattke declared Executive Session over at 3:45 p.m. 

On motion the Board adjourned to meet next on June 5, 2007 at 9:00 a.m.
