The Board of Beadle County Commissioners met Monday – June 30, 2008 at 9:00 a.m., pursuant to adjournment of June 26, 2008 with members present: Chairman Marcus, Vice Chairman Chase, Drake, Mattke and Werner.

Moved by Chase, seconded by Drake. Motion carried. To approve Care of Poor Policy for July 1, 2008 thru June 30, 2009 with changes as noted by Deb Bozentko, Beadle County Welfare Director.

At 11:30 a.m. Chairman Marcus announced time to consider Conditional Use Permit Application from Trans Canada Keystone Pipeline to construct a pump station in the SE4 Section 4-113-59 (Barrett Township). Tract PS-SD-BD-0693.000 Carpenter Pump Station Addition.

Those in attendance were Matthew Bock and Elizabeth Lewis from Woods, Fuller, Shultz & Smith, Attorney’s representing TransCanada Keystone Pipeline; Roger Phillips from TransCanada Keystone Pipeline; Ron Golden, East River Electric; Lynn Kruse, Dakota Energy; Paul Kleist & Mark Wattier, TransCanada Keystone Pipeline represents; Pat Tschetter, Director of Equalization, Delwin Hofer and Kim Madsen, landowners in Barrett Township.
Those representing TransCanada Keystone Pipeline presented a drawing of the 5 acre parcel showing placement of equipment and buildings. Informed those present that the three pumps will be electric and the 5000HP unites will be outside the buildings and will run constantly on variable frequency drives at 50 DB. The Commissioners and landowners had considerable concerns of how loud 50 DB was. Kim Madsen informed the board he was not against the project, but he has a cow/calf operation right next to the pump station site, so he has concerns on the impact of the noise and wanted a recourse to go to if noise became a problem. Delwin Hofer, landowner, wondered about what kind of noise barrier would be considered. TransCanada Keystone informed him that if there was a problem, a wall, trees or placement of pumps in a building could be a resolution, but until this project is in operation this is an unknown.

Moved by Chase, seconded by Mattke. Motion carried. To approve Conditional Use Permit to construct a pump station along the Keystone Pipeline route with a condition that after one year of operation or sooner if complaint filed with TransCanada Keystone by surrounding landowners that TransCanada Keystone will conduct a noise study at various locations from the property line to within ½ mile of property line. Also if additional fourth pump is added a new study to be completed after one year of operation or sooner if complaint filed with TransCanada Keystone by surrounding landowner that TransCanada Keystone will conduct a noise study at various locations from the property line to within ½ mile of property line. If barrier is needed this would have to be agreed upon by the complainant and TransCanada Keystone.

Commissioners met with the elected officials to go over union proposals.
