PROCEEDINGS OF THE BEADLE COUNTY COMMISSION
JULY 15, 2008
The Board of Beadle County Commissioners met on Tuesday – July 15, 2008 at 9:00 a.m., pursuant to adjournment of July 10, 2008 with members present: Chairman Marcus, Vice Chairman Chase, Drake, Mattke and Werner.
The minutes of July 10, 2008 were approved as read with no additions or changes.
Moved by Chase, seconded by Mattke. Motion carried. To adopt the following resolution:
RESOLUTION 07-02-08
“PLAT OF WAGNER OUTLOT 1, A PART OF
THE NW4 SECTION 30-109-62
BEADLE COUNTY, SOUTH DAKOTA”
On recommendation of the Beadle County Planning Commission: BE IT RESOLVED: by the Board of Beadle County Commissioners that the plat of “Wagner Outlot 1, a part of the NW4 of Section 30-109-62, Beadle County, South Dakota west of the 5th p.m., Beadle County, South Dakota, as described above and drawn hereon be approved and accepted and the Auditor hereby is
instructed to endorse on such plat a copy of this resolution and to certify the same.
Moved by Drake, seconded by Chase. Motion carried. To adopt the following resolution:
RESOLUTION 07-03-08
“CORRECTION PLAT FOR – TRACT 714,
A PART OF THE SE4 & A REPLAT OF M & K
OUTLOT 1 IN THE SE4 ALL IN SECTION 32-112-65”
On recommendation of the Beadle County Planning Commission: BE IT RESOLVED: by the Board of Beadle County Commissioners that the “Correction Plat for – Tract 714, a part of SE4 & a replat of M & K Outlot 1, in the SE4 all in
Section 32-112-65”, West of the 5th P.M., Beadle County, South Dakota, as described above and drawn hereon be approved and accepted and the Auditor hereby is instructed to endorse on such plat a copy of this resolution and to certify the same.
Moved by Chase, seconded by Drake. Motion carried. To adopt the following resolution:
RESOLUTION 07-04-08
“RECONVEYANCE”
WHEREAS, the Tax Deed to the following described real property to-wit: Lots One (1) thru Four (4), Block Thirty-five (35), First Addition, Town of Wolsey Beadle County, South Dakota, was taken for unpaid taxes, and,
WHEREAS, the record owners therefore paid Beadle County Treasurer all taxes, interest and cost represented in such years,
NOW, THEREFORE, BE IT RESOLVED: That the above described real property shall be reconveyed to Gary Lee Eichstadt the owner of record therefore in the manner as provided by SDCL 10-25-41, after the time for appeal for such resolution has expired.
Moved by Werner, seconded by Drake. (Chase abstain) Motion carried. To approve variance request of Neil/Mona Kotas & Overbilt Inc to install a rail spur in an area zoned R-O (Large Lot Residential District) located in the Joint Jurisdictional Area. Legal description: Lots 1-3 of Kotas Country Estates. Neil & Mona Kotas and Scott Rink were in attendance to answer questions.
Moved by Chase, seconded by Werner. Motion carried. To approve variance request of Eldon Hofer to build Morton Building (60’x88’) 55’ from center of road or 22’ out of the right of way where ordinance requires 75’ out of the right of way. Legal description: NW4, Section 33, Pleasant View Township.
Moved by Drake, seconded by Chase. Motion carried. To approve variance request and moving permit for Jerry & Kristi Huizenga to move a 10 ½ x 12 ½ shed on their lot and put it 7’ from the property line when the ordinance requires 15’ from the property line. One condition attached that the concrete slab the shed to be placed on, be elevated as the lot is low. Legal description: Lot 3, a part of Lot 1 and the NW4, SE4, Section 23, Paul J Gross Addition to Lake Byron. (40451 North Shore Road)
Commissioners discuss at great lengths the 2009 Provisional Budget and a two year Opt Out of $475,000.00. The Commission will be reviewing the 2009 Provisional Budget again next week to make budget cuts of approximately $500,000.00 so as to not put additional tax burden on tax payers by enacting an Opt Out at this time.
The Board adjourned to meet next on July 22, 2008 at 9:00 a.m.
