The Board of Beadle County Commissioners met Wednesday – November 26, 2008 at 8:45 a.m., pursuant to adjournment of November 18, 2008, with members present: Chairman Marcus, Vice Chairman Chase, Drake, Mattke and Werner.


The minutes of November 18, 2008 were approved as read with no additions or changes.

RESOLUTION 11-03-08
“RECONVEYANCE”

WHEREAS, the Tax Deed to the following described real property to-wit: West Twenty-Five Feet (W25’) of Lots Twelve (12), Thirteen (13) and Fourteen (14) and West Twenty-Five Feet (W25’) of South Fifteen Feet (S15’) of Lot Eleven (11), Block Eight (8), Original Town Addition, City of Huron, Beadle County, South Dakota, was taken for unpaid taxes, and,

WHEREAS, the record owners therefore paid Beadle County Treasurer all taxes, interest and cost represented in such years,

NOW, THEREFORE, BE IT RESOLVED: That the above described real property shall be reconveyed to City of Huron the owner of record therefore in the manner as provided by SDCL 10-25-41, after the time for appeal for such resolution has expired.


Moved by Werner, seconded by Drake. Motion carried. To approve variance request of Cliff Parkhurst to construct a new home on two 1 acre lots and allowed to use existing septic system (Legal: Kropf & Kropf Smith Outlot in SE4 less Lot H-1 Kropf Outlots Section 33, Valley Township.)

To approve Conditional Use Permit of Mark LaFreniere to operate a church with a 4’x8’ sign where code requires a Conditional Use Permit in an area zoned R-1 (One family residential) Legal: Sorenson Lots 1-3, a replat of Otl A in the NE4, SW4 Section 2, Clyde Township.

To approve Variance Request of Melanie Harrington DBA Ravine Lake Recreation to allow billboard advertising at 457 Custer Ave NE (DJ’s Travel Center) as long as the billboard signage is used to promote Ravine Lake Recreation and as long as the facility use stays the same.

“PLAT OF LEHMEN’S FIRST ADDITION, A PART OF OUTLOT 4

AND A REPLAT OF OUTLOT 10, ALL IN THE SE4 OF SECTION 32-111-61 
BEADLE COUNTY, SOUTH DAKOTA”

On recommendation of the Beadle County Planning Commission: BE IT RESOLVED: by the Board of Beadle County Commissioners that the plat of “Lehmen’s First Addition, a part of Outlot 4 of Lyman Plat of Outlots 4, 5, 6, 7, 8 
and H9 and a replat of Outlot 10 all in the SE4 of Section 32-111-61, Beadle County, South Dakota west of the 5th p.m., Beadle County, South Dakota, as described above and drawn hereon be approved and accepted and the Auditor 
hereby is instructed to endorse on such plat a copy of this resolution and to certify the same.

Moved by Werner, seconded by Drake. Motion carried. To approve for Chairman Marcus to sign 2009 Contract for Community Health Services with SD Department of Health in the amount of $13,390.00.

At 10:45 a.m. the Chairman declared time for Public Hearing Sale of Alcoholic Beverage License hearing for 2009 Licensing Period. Received application for Fowl Play Inc.


Moved by Werner, seconded by Drake. Motion carried. To approve the application for 2009 License for Retail On-Sale Liquor Sunday Opening to Fowl Play Inc. 

Moved by Werner, seconded by Mattke. Motion carried. To approve to lease two John Deere 7330 MFWD tractors from James River Equipment for 2009 at a rate of $7.00 per hour up to 300 hours, $8.00 per hour from 300 to 400 hours and $17.00 per hour over 400 hours.


At 11:00 a.m. the Chairman declared bidding closed and the notice to bidders for #1 Diesel or Premium #2 Fuel and Ethanol was read. The following bid was received:
