| PROCEEDINGS OF THE BEADLE COUNTY COMMISSIONERS JANUARY 20, 2009 The Board of Beadle County Commissioners met Tuesday – January 20, 2009 at 8:00 a.m., pursuant to adjournment of January 15, 2009 with embers present: Chairman Marcus, Vice Chairman Drake, Benson, Mattke and Werner. The minutes of January 15, 2009 were approved as read with no additions or changes. Moved by Drake, seconded by Benson, Motion carried. To approve 2009 Drug Agreements for the following Pharmacies: K-Mart, Lewis Drug, Coborn’s and Northside Pharmacy. Moved by Drake, seconded by Benson. Motion carried. To approve 2009 JDC Agreements with the following Counties: Aurora, Bennett, Brule, Charles Mix, Edmunds, Hamlin, Hand, Hanson, Hughes, Hyde, Jerauld, Kingsbury, Marshall, McCook, Sanborn, Spink, Stanley, Sully, Tripp, Turner & Union. Moved by Benson, seconded by Drake. Motion carried. To approve 2009 Jail Agreements for the following Counties: Hand, Hyde, Jerauld, Kingsbury, Sanborn and Spink. Beth Lewis a representative from Trans Canada met with Board to discuss getting a Conditional Use Permit. Moved by Drake, seconded by Benson. Motion carried. To approve Conditional Use Permit Application to construct a 33 foot telecommunication tower for pump station in the SE4 of Section 4, Barrett Township. Moved by Drake, seconded by Mattke. To adopt the following resolution: RESOLUTION 01-03-09 “REPLAT OF TRACT PS-SD-BD-0693.0000 CARPENTER PUMP STATION ADDITION IN THE SE4 OF SECTION 4-113-59 BEADLE COUNTY, SOUTH DAKOTA” On recommendation of the Beadle County Planning Commission: BE IT RESOLVED: by the Board of Beadle County Commissioners that the replat of “Tract PS-SD-BD-0693.0000 Carpenter Pump Station Addition in the SE4 of Section 4-113-59, Beadle County, South Dakota west of the 5th p.m., Beadle County, South Dakota, as described above and drawn hereon be approved and accepted and the Auditor hereby is instructed to endorse on such plat a copy of this resolution and to certify the same. Jailers who work between the hours of 6 p.m. and 6 a.m. shall be paid an additional $0.50 per hour for all hours worked during those hours. Guards to be compensated at $35.00 per trip. DAKOTALAND MUSEUM One full time Director, salary $12.05 per hour (20 plus hours with benefits) PUBLIC HEALTH NURSE One full time Secretary, salary $2,368.70 per month One WIC Secretary, salary $13.62 per month COUNTY CORONER $150.00 for examination of each body HIGHWAY APPOINTMENTS Moved by Drake, seconded by Mattke. Motion carried. To appoint Jerry Batien as County Highway Superintendent, effective January 1, 2009 thru December 31, 2010 with a 2009 annual salary of $47,070.00; subject to signature on agreement of employment; one full time Office Assistant, salary of $13.95 per hour; Dave VanDeWalle be appointed as Foreman Supervisor at an hourly salary of $18.05 per hour; Kip Tschetter be appointed as Shop Foreman at an hourly salary of $16.45 per hour. CUSTODIAN APPOINTMENT Moved by Werner, seconded by Benson. Motion carried. To reappoint Gary Fenski as Custodian for Beadle County with a per hour salary of $15.05, and Fred Sylaart as Custodial/Maintenance with a per hour salary of $15.05; subject to signature on agreement of employment. (Supplies must be okayed by the Auditor) EQUALIZATION APPOINTMENT Moved by Drake, seconded by Werner. Motion carried. To reappoint Pat Tschetter as Director of Equalization, with an annual salary of $38,485.00 per year, subject to signature on agreement of employment. Duties to also include those of Planning and Zoning Administrator. PUBLIC WELFARE OFFICE APPOINTMENT Moved by Mattke, seconded Drake. Motion carried. To reappoint Deb Bozentko as Beadle County Public Welfare Director with an annual salary of $34,650.00 per year, subject to signature on agreement of employment. EMERGENCY MANAGEMENT DIRECTOR APPOINTMENT Moved by Benson, seconded by Werner. Motion carried. To reappoint Tom Moeding as Emergency Management Director with an annual salary of $33,813.00 per year, subject to signature on agreement of employment. VETERAN’S SERVICE OFFICER APPOINTMENT Moved by Werner, seconded by Mattke. Motion carried. That Ken Lindblad was appointed Veteran’s Service Officer for a term of four years ending the first Monday in January 2013. The payable salary in 2009 shall be $33,638.00 per year with one Office Administrator, salary of $2,418.70 per month. LONGEVITY COUNTY EMPLOYEES 2009 Employees (does not include elected officials) who have five (5) years continuous employment shall be paid as follows for Longevity. BE IT RESOLVED: That the salary payable to the County Treasurer shall be $44,066.00 for the year of 2009. BE IT RESOLVED: That the salary payable to the County Auditor shall be for 2 month $7,544.34 and 10 months $33,396.70 Auditor Assistant for 2 months shall be $6,679.34 the year of 2009. BE IT RESOLVED: That the salary payable to the County Register of Deeds shall be $44,066.00 for the year of 2009. Moved by Werner, seconded by Mattke. Motion carried. To adopt the following resolution: RESOLUTION 1-6-09 WHEREAS, per SDCL 7—712., the Board of Beadle County Commissioners shall establish the salary of the State’s Attorney. (full time) BE IT RESOLVED: That the salary payable to the State’s Attorney shall be $80,542.00 for the year of 2009. Moved by Werner, seconded by Benson. Motion carried. To adopt the following resolution: RESOLUTION 1-7-09 WHEREAS, per SDCL 7-12-15., the Board of Beadle County Commissioners shall establish the salary of the Sheriff. BE IT RESOLVED: That the salary payable to the Sheriff shall be $56,367.00 for the year of 2009. Moved by Drake, seconded by Mattke. Motion carried. To adopt the following resolution: RESOLUTION 1-8-09 WHEREAS, per SDCL 7-7-3 & 7-7-5, the Board of Beadle County Commissioners shall establish $1,072.00 per month as the salary of the County Commissioners. Extra employees returning second year $12.75 per hour. Those employees not completing their probationary period the first year of employment must complete it the second year, and then will be eligible for the returning employee pay. MENTAL HEALTH BOARD Moved by Drake, seconded by Mattke. Motion carried. To set the Mental Health Board salaries at $40.00 per hour and the Chairman at $82.00 per meeting. Mileage at County rate for actual miles driven. The Mental Health Board consists of the following members: George Danforth – Huron, Beverly Katz – Huron and Jan Lentz – Huron. Chairperson Marcus, appointed Beverly Katz as Chairman and Jan Lentz and George Danforth as members to the Mental Health Board. DEVELOPMENTAL DISABILITIES REVIEW BOARD Moved by Benson, seconded by Mattke. Motion carried. To set the Developmental Disabilities Review Board salaries at $40.00 per hour and the Chairman at $82.00 per meeting. Mileage at county rate for actual miles driven. The Developmental Disabilities Review Board consists of the following members: George Danforth – Huron, Beverly Katz – Huron and Jan Lentz – Huron. Chairperson Marcus, appointed Beverly Katz as Chairman and Jan Lentz and George Danforth as members to the Developmental Disabilities Review Board. TRAVEL COSTS Moved by Mattke, seconded by Drake. Motion carried. To set the following travel and allowance schedule and that all county personnel on official travel must have PRIOR APPROVAL. Maximum reimbursements will be actual cost per day for lodging and needs to be verified by receipt. Meals on same day travel will be reimbursed for actual cost of meals verified by receipt not to exceed State rates. Meals for overnight travel will be reimbursed at the State rates. State rates are as follows: breakfast $5.00, lunch $9.00 and dinner $12.00; and mileage at County rate of $.37 per mile for actual miles driven. Reimbursements for banquet meals at actual costs verified by receipt. INDIGENT BURIAL EXPENSES Moved by Benson, seconded by Drake. Motion carried. To set burial expense rate for indigents at: Casket Services at $1,500.00, opening and closing of grave payment will be made up to but not more than $400.00 and grave liner if required at actual cost. Mileage $.50 per mile. Effective date to follow Beadle County Care Poor Policy dated July 2008 – June 2009. ELECTION SERVICES Moved by Werner, seconded by Benson. Motion carried. To set compensation for election services at $9.00 per hour. Superintendent will receive County rate for one round trip for picking up and returning election supplies. SALES SITES Moved by Drake, seconded by Benson. Motion carried. To set the following sites for legal and judicial sales – the front door of the Courthouse, 450 Third St SW; the Beadle County Highway Shop, 655 4th NW and in the front of the Post Office in other municipalities. OFFICIAL NEWSPAPERS Moved by Werner, seconded by Benson. Motion carried. To designate the following as official newspapers for Beadle County: The Plainsman – Huron SD; Wolsey News – Wolsey, SD; and Times Enterprise – Wessington, SD. PROCUREMENT POLICY Moved by Werner, seconded by Drake. Motion carried. To adopt the following procurement policy practice for better budget control; All heads of departments are authorized to order supplies and services not to exceed $1,000.00 without prior approval of the Commission. These supplies shall be purchased from suppliers within the State of South Dakota whenever possible. A minimum of two (2) quotes will be documented for single purchase exceeding $2,000.00. Maintenance items in accordance with SDCL 5-18-3 are exempt from this policy under bidding laws. INVESTMENTS Moved by Werner, seconded by Benson. Motion carried. To designate the Beadle County Treasurer to invest county monies in approved FDIC, NCUA, F.I.T. and FSLIC Financial Facilities within Beadle County or the State of South Dakota. POOLING MILEAGE ALLOWANCE Moved by Benson, seconded by Werner. Motion carried. To adopt the following resolution: RESOLUTION 1-9-09 WHEREAS, the County Commission is authorized by SDCL 7-7-7 by annual resolution to pool mileage allowance provided by law for each Commissioner; now therefore, BE IT RESOLVED: The Board of Beadle County Commissioners in session the 20th day of January, 2009 do hereby pool mileage allowance and authorize each commissioner to be paid actual mileage expenses subject to fiscal year total mileage expenditure limitation as provided by the law for all Commissioners. To adopt the following resolution: RESOLUTION 1-10-09 The Board of Beadle County Commissioners have adopted the following policy pertaining to the reconveyance of tax deed property: All taxes dues and owing will be collected. Do not collect an in consideration of tax for the tax year. The tax should be processed as an added tax and collected at the normal dates of April 30 and October 31. To adopt the following resolution: RESOLUTION 1-11-09 The Board of Beadle County Commissioners have adopted the policy that Non-Sufficient Funds Checks (NSF) fee will be maximum allowed by the state per check. To approve the following resolution: RESOLUTION 01-12-09 “GRANT SUPPLEMENTAL BUDGET” WHEREAS, unanticipated reimbursements were received from the State of South Dakota Department of Public Safety Office of Homeland Security for US Department of Homeland 2008 Homeland Security Grant Program. The following item will be reimbursed for monies expended in the 2009 year. 226 222.429.08 Emergency Management 2008 HMLS Grant $8,625.00 Total 8,625.00 NOW, THEREFORE, BE IT RESOLVED: that the Board of Beadle County Commissioners do hereby propose, make and move for adoption of this Grant Supplemental Budget in the item set forth above. To adopt the following resolution: RESOLUTION 01-13-09 “GRANT SUPPLEMENTAL BUDGET” WHEREAS, unanticipated reimbursements were received from the State of South Dakota Department of Public Safety Office of Homeland Security for 2007 Public Safety Interoperable (PSIC) Grant Program Match. The following item will be reimbursed for monies expended in the 2009 Budget. 226 222.429.00 Emergency Management 2007 PSIC Grant $ 18,910.32 Total $ 18,910.32 NOW, THEREFORE, BE IT RESOLVED: that the Board of Beadle County Commissioners do hereby propose, make and move for adoption of this Grant Supplemental Budget in the items set forth above. The Board met with Dick Freske and Phil Wiedenman to go over the Courthouse remodel project. The Board met with Barb O’Riley, Mike Moore and Damon Durick from Active Data Optical Scan to discuss the purchase of a scanner. New quote to be given at next meeting. Moved by Benson, seconded by Drake. Motion carried. To approve to fix bridge #03-334-240 in Section 34, Richland Township. (214th Street) Moved by Benson, seconded by Drake. Motion carried. To approve to declare the following two 2001 International trucks as surplus and sell at sealed bid on February 17, 2009 at 10:00 a.m. Serial #1HTSHAAR71H384255 and Serial #1HTSHAAR914384256. Moved by Drake, seconded by Benson. Motion carried. To go into Executive Session at 12:00 p.m. to discuss personnel matters.
