Beadle County Commission Minutes:

PROCEEDINGS OF THE BEADLE COUNTY COMMISSION
MARCH 24, 2009


The Board of Beadle County Commissioners met Tuesday – March 24, 2009 at 9:00 a.m., pursuant to adjournment of March 10, 2009 with members present: Chairman Marcus, Vice Chairman Drake, Benson, Mattke and Werner. 


The minutes of March 10, 2009 were approved as read with no additions or changes.


Pat Tschetter, Beadle County Director of Equalization; met with the Board to discuss the process for assessing property.


Moved by Benson, seconded by Mattke. Motion carried. To approve to rent a 2008 Pneumatic Roller for $2,500.00 per month for up to 5 months.


At 10:30 a.m. Chairman Marcus declared bidding closed and the notice to bidders for Road Oil was read. The following bids were received:

1) Jebro Inc – Sioux City IA 
MC-3000 $639.25 per ton
CRS-2P $519.25 per ton

2) Flint Hills Resources – Marshall MN
MC-3000 $557.06 per ton delivered
CRS-2P $459.62 per ton delivered
MC70 $657.06 per ton delivered

Moved by Benson, seconded by Drake. Motion carried. To approve bid from Flint Hills Resources as being lowest bidder and in the best interest of Beadle County.


At 10:35 a.m. Chairman Marcus declared bidding closed and the notice to bidders for Hot Mix was read. The following bid was received:

1) Asphalt Paving & Materials Co – Huron SD
Huron Site (Hwy 14 E) 
C1 D-I
PG 64-22 AC $58.50 per ton

Due to the fact that no other bids were received for Hot Mix according to the specifications in the notice to bidders, it was moved by Drake, seconded by Benson. Motion carried. To accept the bid from Asphalt Paving & Materials, with the stipulations that Jerry Batien, Beadle County Highway Superintendent has the right to reject said Hot Mix bid and that Beadle County is not held to the minimum tonnage.


At 10:40 a.m. Chairman Marcus declared bidding closed and the notice to bidder for Rental of Miscellaneous Road Equipment was read. The following bids were received:

1) Beckler Construction – Redfield SD

2) Darrell’s Rock, Sand & Gravel – Wessington Springs SD

3) Hollaway Construction Co Inc – Mitchell SD

4) Dakota Trucking Inc – Wessington Springs SD

5) Odland Construction & Gravel – Redfield SD


Moved by Werner, seconded by Benson. Motion carried. To accept and file all bids submitted as being in the best interest of Beadle County, pending they all provide proof of insurance. 


Moved by Werner, seconded by Drake. Motion carried. To approve for Jerry Batien, Beadle County Hwy Supt to attend the SDLTAP Course on Fundamentals of Managing Roads & Street in Mitchell SD on April 2, 2009, Asphalt Conference in Pierre SD on April 8 & 9, 2009 and for Mike Moore, Beadle County States Attorney to attend ABA Criminal Justice Section Board Meeting & CLE April 3-5, 2009 in Birmingham AL and acknowledge that he attended the SDAA Spring Board Meeting in Baltimore MD March 19-22, 2009.


Moved by Mattke, seconded by Werner, Motion carried. To approve for Jerry Batien, Beadle County Hwy Supt to purchase two pull tarp systems for the 2009 Bottom Dump Pup trailers from Northern Truck Equipment in the amount of $7,724.00.


Moved by Werner, seconded by Benson. Motion carried. To set April 14, 2009 at 9:15 a.m. as bid date and time for Washed Rock Type 1B and Washed Crushed Rock Type 2A.


Moved by Werner, seconded by Benson. Motion carried. To approve to declare a 1986 Ford F350 Pickup (1FDKF37Y1GPA71161) from the Beadle County Weed & Pest and two 2002 Case International MXM 130 tractors (ACM192755 and ACM192655) from the Beadle County Highway Department as surplus and to be sold at the Bales Auction on April 25, 2009. 







Moved by Drake, seconded by Werner. Motion carried. To adopt the following resolution:

RESOLUTION 03-03-09
"DAKOTA AIR SPRAY INC" 

WHEREAS, Dakota Air Spray, Inc. Huron South Dakota, is requesting permission to operate, take off or land an aircraft on any county or township road in Beadle County, for the purpose of servicing said aircraft in preparation for aerial application of chemical or fertilizer materials, and
WHEREAS, Dakota Air Spray, Inc. has agreed to abide by the safety rules adopted by the Aeronautics Commission which is granted authority by subsections 2 and 3 of Section 70:02:02:08 of South Dakota Administrative Rule under the authority of SDCL 50-2-2.1 and assume all liability when using said roads, and
NOW THEREFORE, BE IT RESOLVED: The Beadle County Commissioners in Regular session this 24th day of March, 2009 by unanimous vote, do hereby grant Permission to Dakota Air Spray, Inc to use said roads for requested use.


Moved by Drake, seconded by Werner. Motion carried. To approve variance request of Frances L Fritz to build a new house where the old house is located which is closer than the 75’ setback required. NE4 of Section 19-109-59 Belle Prairie Township.


Moved by Werner, seconded by Benson. Motion carried. To approve Agreement with Sanborn County & CVSO in the amount of $7,500.00 per year.


Kathie Bostrom, Deputy for Beadle County met with the Commissioners at 11:30 a.m. to show them the video titled “How Heavy is too Heavy for South Dakota Roads”. 


Moved by Drake, seconded by Mattke. Motion carried. To approve to not release the FY2009 Homeland Security Grant Funds to South Dakota Department of Public Safety.


Moved by Mattke, seconded by Benson. Motion carried. To approve for Deb Bozentko to be on the County Catastrophic Poor Relief Program (CCPRP) Committee.


The Board adjourned to meet next on March 31, 2009 at 9:00 a.m.
