PROCEEDINGS OF THE BEADLE COUNTY COMMISSION
August 11, 2009

The Board of Beadle County Commissioners met Tuesday – August 11, 2009 at 9:00 am, pursuant to adjournment of August 4, 2009 with members present: Chairman Marcus, Vice Chairman Drake, Benson, Mattke and Werner. 
The minutes of July 30, 2009 and August 4, 2009 were approved.
At 9:00 a.m. the Beadle County Surplus Land Sale was held with no properties being sold.
The Board of Commissioners met with all department heads to go over the Budget for 2010.
Huron Title Company met with the board along with Barb O’Riley, Beadle County Register of Deeds, Deb Bozentko, Beadle County Welfare Director and Mike Moore, Beadle County States’ Attorney to discuss concerns they have over not being able to get copies of all county poor liens that are recorded in the Register of Deeds Office, which they say they need in order to keep their license as a title company. Since the county poor liens have information on them that are protected by HIPPA, Deb Bozentko voiced concerns over why the all of the poor liens are required to be on file at the Huron Title Company. Several options were discussed as possible plans to help Huron Title get the information that they may need, yet keeping the HIPPA laws protected. The board asked that all parties get together and come up with a plan and bring it back to the commissioners. 
Deloris Brown met with the board concerning the letter she received condemning her property located in the Town of Cavour. Deloris stated that she had been trying to sell the property with the stipulation that it needs to be torn down, but now with this letter is wondering if she can sell the property. She also is requesting abatement on her property because the value of the house increased, yet they condemned the property. The board denied her request for abatement on the property, and told her that she needs to give an action plan on how and when she is going to destroy the condemned house by August 24, 2009 to the Director of Equalization Office.
Moved by Benson, Seconded by Mattke, to accept the proposal in the amount of 12,000.00 from Sentry Insurance regarding the damage done by M.D. Products not sending the correct bolts to put the fenders on the 5 Cat motor graders. Mike Moore, Beadle County States’ Attorney was advised to accept the above proposal with the understanding of all parties involved that the warranty on all of the Motor graders would still be in effect. Ayes: 4 Nays: 1 Motion Carried.
Moved by Werner, seconded by Drake. Motion carried to authorize Mike Moore, Beadle County States’ Attorney to seek proposals for indigent counsel services in Beadle County for a two (2) year contract, and to publish said proposal in the State Bar of South Dakota Newsletter. The deadline must be submitted to the Beadle County Auditor by September 15, 2009 and an informal meeting will be held on August 27, 2009 at 11:30 a.m.

Moved by Werner, seconded by Mattke, motion carried. To approve the Sub Agreement between the South Dakota Secretary of State and Beadle County for Help America Vote Act (HAVA) grant money in the amount of $398.73.
Moved by Werner, seconded by Benson, motion carried. To go into Executive Session for personnel matters at 2:20 p.m. Executive Session over at 2:45 p.m.
