On recommendation of the Beadle County Planning Commission: BE IT RESOLVED; by the Board of Beadle County Commissioners that the plat to vacate Waldner Outlots Four (4) and Five (5), a part of the South West Quarter (SW ¼) of Section Twenty Seven (S. 27), Township One Hundred Eleven North (T. 111 N.), Range Sixty One West (R. 61 W.)of the Fifth Principal Meridian (5th P.M.), Beadle County, South Dakota, as described above and drawn hereon be approved and accepted and the Auditor hereby is instructed to endorse on such plat a copy of this resolution and to certify the same.

On recommendation of the Beadle County Planning Commission : BE IT RESOLVED; by the Board of Beadle County Commissioners that the plat of Waldner Outlots Four A (4A) and Five A (5A), the West Eight Hundred Sixty Feet (W. 860 ‘) of the South Seven Hundred Fifty Feet (S. 750 ‘) of the South West Quarter (SW ¼ ) of Section Twenty Seven (S. 27), Township One Hundred Eleven North (T. 111 N.), Range Sixty One West (R. 61 W.)of the Fifth Principal Meridian (5th P.M.), Beadle County, South Dakota, as described above and drawn hereon be approved and accepted and the Auditor hereby is instructed to endorse on such plat a copy of this resolution and to certify the same.

To accept and sign the correction acknowledgement letter from Merchants Capital amending the payment structure to the Municipal Lease No. 101282001 – (5) 2009 CAT 140M Motor Graders, and to acknowledge the check in the amount of $917.03 for a partial refund on the January 1, 2009 payment.

RESOLUTION 08-07-09
GRANT SUPPLEMENTAL BUDGET
WHEREAS, UNANTICIPATED REIMBURSEMENTS WERE RECEIVED FROM THE STATE OF SOUTH DAKOTA FROM SD DEPARTMENT OF HEALTH FOR THE POD PROGRAM DEVELOPMENT. THE FOLLOWING ITEM WILL BE REIMBURSED FOR MONIES EXPENDED IN THE 2009 BUDGET.
226 222 429.02 EMERG MGMT POD GRANT $ 12,500.00
NOW, THEREFORE, BE IT RESOLVED, THAT THE BOARD OF BEADLE COUNTY COMMISSIONERS DO HEREBY PROPOSE, MAKE AND MOVE FOR ADOPTION OF THIS GRANT SUPPLEMENTAL BUDGET IN THE ITEM SET FORTH ABOVE.

Moved by Mattke, seconded by Werner, motion carried. To approve the request by Lloyd and Jean Spain to release a Restrictive Covenant as recorded in the Beadle County Register of Deeds office on July 18, 2003 in Disk 1g #1929 on their property legally described as:
(a) The Newill Lot located in the NW ¼ of Section 31, Township 111 North, Range 61 West of the 5th Prime Meridian in Beadle County, South Dakota, and
(b) The Spain Outlots 1 and 2 located in Lot “C” of the Plat of Lots “A”, “B” and “C” in the NW ¼ of Section 31, Township 111 North, Range 61 West of the 5th Prime Meridian in Beadle County, South Dakota.

At 1:00 Chairman Marcus joined the meeting, and Vice Chairman Drake turned the remainder of the meeting over to Chairman Marcus.
