PROCEEDINGS OF THE BEADLE COUNTY COMMISSION
OCTOBER 6, 2009
The Board of Beadle County Commissioners met Tuesday, October 6, 2009 at 9:00 am, pursuant to adjournment of September 30, 2009 with members present: Chairman Marcus, Vice Chairman Drake, Benson, and Mattke. Absent: Werner.
The Minutes of September 30, 2009 were approved.
Moved by Drake, Seconded by Benson, motion carried to approve Chairman Marcus to sign the early retirement contract (effective date of December 1, 2009) with Dennis Owens, Beadle County Highway Patrol Operator. The Board would like to thank Dennis for his 36 ½ years of working with Beadle County, and congratulate him on his retirement.
Moved by Benson, seconded by Mattke, motion carried to go into Executive Session at 9:25 a.m. Chairman Marcus declared executive session over at 10:30 a.m.
Moved by Mattke, seconded by Benson, motion carried to declare as surplus and sell at Bales Consignment Auction on November 7, 2009, 2000 Ford Crown Victoria Title #11958628, VIN# 2FAFP71WXYX192158.
Moved by Drake, seconded by Benson, motion carried to approve Doug Solem, Chief Deputy to purchase from surplus a 2004 Ford Crown Victoria in the amount of $9,300.00

RESOLUTION 10-02-09
“SATISFACTION OF LIEN”
I, Jill Hanson, duly appointed, qualified and acting County Auditor of Beadle County, South Dakota, pursuant to resolution duly adopted by the Beadle County Board of Commissioners on October 6,2009 do hereby release the following real estate, to-wit:
E 74’ of Lot 8, Block 5, Chambers 1st Addition to the City of Huron
From the effect of the Poor Relief Lien for the settlement of $6,000.00. The County Aid Lien in the amount of $8,168.95 will be satisfied in full and is on file in the County Public Welfare office and in the Office of the Register of Deeds of Beadle County, South Dakota.

PUBLIC NOTICE
RESOLUTION 10-03-09
WHEREAS, there is a possibility of heavy snow cover in Beadle County this year, snow removal is a problem for all of the people in the county; therefore, we the Beadle County Commissioners in pursuant to SDCL 31-13-56 are asking the residents of rural Beadle County to refrain from pushing snow from private property onto the Public Highway Right - of - Way. We also are requesting that all hay bales be removed from Public Right - of - Way by November 1, 2009, and
NOW, THEREFORE, BE IT RESOLVED: PENALTY FOR NON - COMPLIANCE
WITH THIS REQUEST - any person dumping snow on County Highways or Right - of - Way is in violation of SDCL 34A-7-6 and guilty of a Class 2 Misdemeanor, which is punishable with a $100.00 fine or 30 days in jail. In addition, the court may enforce removal of snow or other debris and tax the cost for such removal against any individual convicted of such violation.
Moved by Mattke, seconded by Benson, motion carried to approve Tom Beerman, Beadle County Sheriff to attend Sheriff Convention in Watertown South Dakota on October 21 to 23, 2009.
Moved by Benson, seconded by Drake, motion carried to table bids until October 13, 2009 for labor and materials to shape the existing roadway, repair soft spots and install county furnished gravel surfacing on 17 miles of Beadle County Highways in the Northeast corner of the County
Moved by Drake, seconded by Benson, motion carried to table bid until October 13, 2009 for labor and materials to install an asphalt leveling course on 12 miles of 418th Avenue from 196th Street to 208th St, Beadle County Highway 39, beginning at U.S. Highway 14 on 418th Avenue.
Moved by Benson, seconded by Mattke, motion carried to approve Mike Moore to attend National Convention on Domestic Violence in San Antonio Texas on November 1 to 4, 2009 and to pay for domestic abuse victim and guest’s airline ticket.
Moved by Benson, seconded by Mattke, motion carried to approve Jerry Batien, Beadle County Highway Superintendent to apply for State Wide Infrastructure Bank Fund.
The Board adjourned to meet next on October 13, 2009 at 9:00 a.m.
