PROCEEDINGS OF THE BEADLE COUNTY COMMISSION
NOVEMBER 10, 2009

The Board of Beadle County Commissioners met Tuesday, November 10, 2009 at 9:00 am, pursuant to adjournment of October 29, 2009 with members present: Chairman Marcus, Vice Chairman Drake, Benson, Mattke and Werner.
Moved by Drake, seconded by Benson, motion carried to accept the offer from Keystone Pipeline Company in the amount of Five Hundred Two Thousand Eight Hundred Seventy One (502,871.00) in full payment and settlement for all damages to Beadle County Gravel Surfaced Roads as a result of hauling and all construction-related road use and authorize Chairman Marcus to sign the Release of Damage Claims.
Moved by Mattke, seconded by Drake, motion carried to approve the bid of September 30, 2009, from Forrest Excavating (their bid was extended on October 29, 2009 for 30 days) in the amount of $300,068.34 because of the settlement with Keystone Pipeline Company for labor and materials to shape the existing roadway, repair soft spots and install county furnished, gravel surfacing on 17 miles of Beadle County Highways in the Northeast corner of the County.
Moved by Benson, seconded by Mattke, motion carried to declare an emergency and authorize Jerry Batien, Beadle County Highway Superintendent to get quotes for not less than 40,000 tons of crushed Base Course Gravel, which must meet State Specs, within 18 miles of the intersection of Hwy 28 and 418th Avenue located in the northeast corner of Beadle County. Emergency arose when settlement with Keystone Pipeline Company was not reached in time for Beadle County to go off another Counties gravel bid.
The following emergency quotes for not less than 40,000 tons of crushed Base Course Gravel within 18 miles of the intersection of HWY 28 and 418th Avenue located in the northeast corner of Beadle County.

Moved by Werner, seconded by Drake, motion carried to approve quote received from Brownlee Construction Inc for up to 40,000 tons at $3.24 per ton as being in the best interest of Beadle County.
Moved by Benson, seconded by Mattke, motion carried to approve the change order from Midland Contracting Inc on Route 19 with the notation that this change order will not go over the original contract amount.
The Board met with Ted Dickey of North East Council of Governments (NECOG) and Dick Freske, to discuss where the County is in the process of applying for the Energy Efficiency and Conservation Block Grant for a new heating system in the Courthouse and Correction Center, and to see if there are any options that the County can do to improve our chances of receiving this grant funding.
Moved by Benson, seconded by Drake, motion carried to go into Executive Session at 10:30 a.m. for legal counsel. Chairman Marcus declared Executive Session over at 10:45 a.m. 
The Board met with members of the Beadle County Bar Association to discuss a 2-year (2010-2012) Indigent Counsel Agreement.
Moved by Mattke, seconded by Benson motion carried to go into Executive Session at 11:30 a.m. for legal counsel. Chairman Marcus declared Executive Session over at 11:35 a.m.
Moved by Werner, seconded by Mattke, motion carried to approve Mike Moore, Beadle County State’s Attorney to draft a new policy effective immediately for a minimum administrative fee charge of $100.00 on any document requiring the Chairman signature.
Moved by Werner, seconded by Mattke, motion carried to adopt the following resolution from Mid-Dakota Rural Water System, Inc. pending $100.00 administrative fee.

RESOLUTION NO. 11-01-09, AMENDING RESOLUTION NO. 8-10-98, AND GRANTING MID-DAKOTA RURAL WATER SYSTEM, INC., ADDITIONAL COUNTY-WIDE AUTHORITY FOR THE PURPOSE OF OPERATING AND MAINTAINING THE BEADLE COUNTY PORTION OF THE MID-DAKOTA RURAL WATER PROJECT.
On August 31, 1998, the Board of County Commissioners of Beadle County, South Dakota, adopted Resolution No. 8-10-98, whereby they granted a county-wide authorization to Mid-Dakota Rural Water System, Inc. for the purposes of constructing the Beadle County portion of the Mid-Dakota Rural Water Project.
Mid-Dakota Rural Water System, Inc., has now applied to the Board of County Commissioners of Beadle County, South Dakota, to amend the above-referenced resolution to include water pipelines and related appurtenances previously constructed and installed by Southern Spink/Northern Beadle Rural Water System and conveyed to Mid-Dakota Rural Water System, Inc.
Notice was duly given by mail of the application of Mid-Dakota Rural Water System, Inc., to all persons, firms or corporations owning or operating electric, telephone or telegraph lines within Beadle County, South Dakota, in compliance with SDCL 31-26-13. All comments received were considered by the Beadle County Commissioners.
The Resolution set forth below was adopted pursuant to SDCL 31-26-25 by the Board of County Commissioners of Beadle County, South Dakota, at a regular meeting which was held in the Commission Room in the Courthouse in the City of Huron, Beadle County, South Dakota, on the 10th day of November, 2009.
After discussion, the following Resolution, upon motion duly made, seconded and carried, was unanimously adopted:
BE IT RESOLVED that Resolution NO. 8-10-98, adopted by the Beadle County Board of Commissioner on August 31, 1998, is hereby amended to include within its scope underground pipeline and the related appurtenances, used for the purpose of transmitting water, acquired by Mid-Dakota Rural Water System, Inc., from Southern Spink/Northern Beadle Rural Water System;
BE IT FURTHER RESOLVED that the terms and conditions of Resolution No. 8-10-98 shall remain in full force and effect, and shall apply with equal force to the pipeline and related appurtenances acquired by Mid-Dakota Rural Water Systems, Inc., from Southern Spink/Northern Beadle Rural Water System. 
The Board adjourned to meet next on November 17, 2009 at 9:00 a.m.
