PROCEEDINGS OF THE BEADLE COUNTY COMMISSION
NOVEMBER 17, 2009
The Board of Beadle County Commissioners met Tuesday, November 17, 2009 at 9:00 am, pursuant to adjournment of November 10, 2009 with members present: Vice Chairman Drake, Benson, Mattke and Werner. Absent Chairman Marcus.
At 9:30 a.m., Vice Chairman Drake declared time for 1st Public Hearing- for the Amendment to Section 2602 from Beadle County Zoning Regulations 1998. Present was Pat Tschetter Beadle County Director of Equalization and Brad Tschetter. Brad Tschetter questioned what the fees for the permits would be and stated that he doesn’t disagree to the building permits, but feels that the building permits are too high. 2nd and final Public Hearing will be on November 30, 2009 at 9:30 a.m.
Moved by Werner, seconded by Benson, motion carried to adopt the following resolution:
RESOLUTION 11-02-09
“PLAT OF BOOMSMA ADDITION NO. 2, A PART OF THE NORTHWEST QUARTER OF SECTION 26, TOWNSHIP 112 NORTH, RANGE 64 WEST OF THE 5TH P.M. BEADLE COUNTY, SOUTH DAKOTA.”
On recommendation of the Beadle County Planning Commission: BE IT RESOLVED: by the Board of Beadle County Commissioners that the plat of Boomsma Addition No. 2 a part of the Northwest Quarter(N.W. ¼ ) of Section Twenty Six (S. 26), Township One Hundred Twelve North (T. 112 N.), Range Sixty Four West (R. 64 W.) of the Fifth Principal Meridian (5 th P.M.), Beadle County, South Dakota as described above and drawn hereon be approved and accepted and the Auditor hereby is instructed to endorse on such plat a copy of this resolution and to certify the same.

RESOLUTION 11-03-09
“PLAT OF LOT 2 OF LARSEN ESTATES IN THE SW ¼ OF SECTION 24, TOWNSHIP 111 NORTH, RANGE 64 WEST OF THE 5TH P.M., TOWN OF WOLSEY, BEADLE COUNTY, SOUTH DAKOTA
On recommendation of the Beadle County Planning Commission: BE IT
RESOLVED: by the Board of Beadle County Commissioners that the plat of Lot Two (L. 2) of Larsen Estates in the South West Quarter (S.W. ¼) of Section Twenty Four (S. 24), Township One Hundred Eleven North (T. 111 N.), Range Sixty Four West (R. 64 W.) of the Fifth Principal Meridian (5 th P.M.), Town of Wolsey, Beadle County, South Dakota, as described above and drawn hereon be approved and accepted and the Auditor hereby is instructed to endorse on such plat a copy of this resolution and to certify the same.

“PLAT OF GRAND VIEW A REPLAT OF A PART OF OUTLOT “B” IN THE EAST ½ OF SECTION 18, TWP. 110 NORTH, RGE. 61 WEST OF THE 5TH P.M., BEADLE COUNTY, SOUTH DAKOTA”
On recommendation of the Beadle County Planning Commission: BE IT
RESOLVED; by the Board of Beadle County Commissioners that the plat of
Grand View a replat of Outlot B in the East Half (E ½) of Section Eighteen (S. 18), Township One Hundred Ten North (T. 110 N.), Range Sixty One West (R. 61 W.) of the Fifth Principal Meridian (5th P.M.), Beadle County, South Dakota, as described above and drawn hereon be approved and accepted and the Auditor hereby is instructed to endorse on such plat a copy of this resolution and to certify the same.
Moved by Benson, seconded by Mattke, motion carried to deny the Rezoning request of Charles Price, Mike Rogers Construction & Tim Amundson Construction legally described as NE ¼ of SW ¼ , Section 13, Township 110, Range 62 from R-O (Large Lot Residential District) to R-3 (One Family, Two Family and Townhouse Residential District).
Moved by Werner, seconded by Benson, motion carried to renew the Intergovernmental Agreement for the purposes of sharing 911 telephone emergency call services for one year.
Moved by Werner, seconded by Mattke, motion carried to approve the Election Systems & Software (ES&S) Hardware/Firmware Maintenance and Support Sales Agreement Purchase Order.
Moved by Werner to deny the request of United States Department of the Interior for operation and maintenance of one streamflow gaging station on the James River near Redfield based on the fact that the James River Water Development District should be able to pay for the cost of maintaining the gaging station. Motion died for a lack of second.
Moved by Mattke, seconded by Werner, motion carried to Deny the request of United States Department of the Interior for operating and maintenance of one streamflow gaging station on the James River near Redfield and give a letter to Geological, Spink County, City of Huron and James River explaining the reason for denying the request is because James River Water Development District’s increase of $162,171.00 to the 2009 payable 2010 taxes. Benson abstained because he is a former Us Geological employee.
The Board of Commissioner’s reviewed the letter dated October 9, 2009 to Duane Majeres, Chairman of Huron Housing and Redevelopment Authority regarding the Neighborhood Stabilization Program Conditional Loan Commitment for Lampe Estates Phase II – Huron South Dakota.
Moved by Werner seconded by Mattke, motion carried to acknowledge that Lampe Phase II would not be subject to Payment In Lieu of Taxes (PILOT).
Moved by Werner, seconded by Mattke, motion carried to approve the Indigent Court Appointed Attorney Two Year Contract from 2010 to 2012 with the Eleven (11) attorney’s that signed in the amount of $170,000.00 and a $4,800.00 Administration fee per year.
Moved by Werner, seconded by Mattke, motion carried to approve Mike Moore, Beadle County State’s Attorney to hire Ellen Kuhler for $4,500.00 (per contract) per month as a Temporary Full Time Beadle County Deputy State’s Attorney due to the fact of all of the criminal trials in Beadle County.
The Board adjourned to meet next on November 30, 2009 at 8:00 a.m.
