PROCEEDINGS OF THE BEADLE COUNTY COMMISSION
JANUARY 14, 2010
The Board of Beadle County Commissioners met Thursday – January 14, 2010 at 9:00 a.m., pursuant to adjournment of January 4, 2010 with members present: Chair Werner, Vice Chair Drake, Benson, Mattke and Marcus.
The minutes of January 4, 2010 were approved as read with no additions or changes.
Chief Deputy, Doug Solem, reported to the board on the countywide cell phone usage
Moved by Marcus seconded by Benson, motion carried to go into Executive Session to discuss personnel matters at 11:15 a.m. Chair Werner declared Executive Session over at 11:25 p.m.
Moved by Benson, seconded by Drake, motion carried to approve Intergovernmental Agreement between Beadle County and the City of Huron for Building Inspector effective January 1, 2010 to December 31, 2010, which is approximately $9,000.00 less than the agreement in 2009.
Moved by Drake, seconded by Mattke to adopt the following resolution:
Resolution 01-02-10
“Plat of Dubro Outlot 1, a Part of the Northeast ¼ of Section 30, TWP 109 North, Rge 59, West of the 5th P.M., Beadle County, South Dakota”.
On recommendation of the Beadle County Planning Commission: BE IT RESOLVED: by the Board of Beadle County Commissioners that the plat of Dubro Outlot 1, a part of the Northeast Quarter (NE ¼) of Section Thirty (S. 30), Township One Hundred Nine North (T. 109 N.), Range Fifty-Nine West (R. 59 W.) of the Fifth Principal Meridian (5th P.M.), Beadle County, South Dakota as described above and drawn hereon be approved and accepted and the Auditor hereby is instructed to endorse on such plat a copy of this resolution and to certify the same.

RESOLUTION 01-04-10
GRANT SUPPLEMENTAL BUDGET
WHEREAS, REIMBURSEMENTS WERE RECEIVED IN 2009 FROM THE SOUTH DAKOTA STATE UNIVERSITY COOPERATIVE EXTENSION SERVICES FOR WISDOM OF THE AGES RETREAT GRANT. THE FOLLOWING ITEM WILL BE REIMBURSED FOR MONIES EXPENDED IN THE 2010 BUDGET.

NOW, THEREFORE, BE IT RESOLVED, THAT THE BOARD OF BEADLE COUNTY COMMISSIONERS DO HEREBY PROPOSE, MAKE AND MOVE FOR ADOPTION OF THIS GRANT SUPPLEMENTAL BUDGET IN THE ITEM SET FORTH ABOVE

Moved by Drake, seconded by Mattke, motion carried to approve to hold supplemental hearing date on January 28, 2010 at 10:00 a.m. for the 2009 money that was allocated to be distributed to the following funds out of the 2009 Budget year, and that was not issued in 2009, therefore a request for said 2009 allocated money be established as a 2010 budget authority. 101 390 429 People’s Transit-$9,000.00;101 419 429 Career Planning Center $1,350.00;101 433 429 Huron Adult Day Care Center $ 810.00; 101 434 429 Huron YWCA Family Violence $2,179.73;101 434 429.01 Jan Manolis Family Safe Center $1,420.27;101 439 429 Huron Advocacy Program $2,025.00;101 521 429 Recreation Program $ 900.00;101 612 429 Soil Conservation $4,500.00. Resolution 01-08-10
RESCISSION OF APPROVAL FOR BEADLE COUNTY REGIONAL RAILROAD AUTHORITY TO LEVY TAXES IN RELATION TO RAIL PROJECT IN HURON, SOUTH DAKOTA.
WHEREAS: the Beadle County Commissioners, Huron, South Dakota did on the 17th day of August, 2009, passed, approved and adopted Resolution 08-03-09 granting approval for the Beadle County Regional Railroad Authority to certify the amount of tax to be levied as allowed by SDCL 49-17A-21 for repayment of an loan to Heartland Grain Fuels, LLC, in the amount of One Million Eight Hundred Fifty Thousand Dollars ($1,850,000.00) amortized over fifteen years at the annual rate of interest of two percent (2%) per year to fund the construction of three rail lines in the DM&E Railroad right-of-way, near the Heartland Grain Fuels, LLC ethanol plant in Huron; and
WHEREAS: Heartland Grain Fuels, L.P., has informed the Beadle County Commissioners that the Heartland Grain Fuels, L.P., will fund the construction project internally, has withdrawn its loan application previously submitted to the South Dakota Railroad Trust Funds, and the certification of the tax to be levied as set for in Resolution 08-03-09 is no longer needed,
NOW THEREFORE, BE IT RESOLVED that the Resolution 08-03-09 is hereby rescinded.
Chair Werner declared the board convened for lunch at 12:00 p.m. to reconvene at 12:30 p.m.
Moved by Drake, seconded by Mattke, motion carried to go into Executive Session at 12:50 p.m. for appointed Officials evaluations. Chair Werner declared Executive Session over at 4:55 p.m.
Moved by Marcus, seconded by Benson, motion carried to allow Jerry Batien, Beadle County Highway Superintendent to attend the NACE 2010 Annual Meeting Conference on April 25 – 29, 2010.
Moved by Benson, seconded by Drake, motion carried to adopt the following resolution: subject to change pending weather conditions.
RESOLUTION 01-09-10
"BEADLE COUNTY SPEED LIMITS & WEIGHT PER AXLE LIMITS"
WHEREAS, the County of Beadle, South Dakota, is responsible for the maintenance of certain highways under its jurisdiction,
WHEREAS, it appears that said highways, by reason of deterioration, rain, snow or other climatic conditions will be seriously damaged or destroyed unless the use of vehicles thereon is prohibited or restrictions as to the weight of vehicles are imposed, and
NOW, THEREFORE, pursuant to SDCL 32-14-6 and any laws amendatory thereto, be it resolved that effective February 15, 2010 through April 30, 2010 the load limit on all Beadle County oil roads will be posted at 6 ton per axle. Beadle County oil roads will be posted at 40 MPH for trucks. With the following exceptions:
1. Yale Road (411 Ave-County Road 31) from Highway 14 north to the Correction Line
(196th St County Road 8) posted at 8 ton per axle and 40 MPH for trucks. From the
Correction Line N on (411 Ave-County Road 31) to SD Highway 28, posted at 6
tons per axle and 40 MPH trucks.
2. County Road 22 – Custer Ave from Highway 14 south to 210th St then west to
Highway 37, posted at legal weight limits and Trucks 40 MPH.
3. Morningside Main will be posted at legal load limits and 30 MPH.
IT IS FURTHER RESOLVED; that there shall be erected and maintained signs designating provisions of this resolution as provided by state law and that this resolution shall not be effective until or unless such signs are erected and maintained.
IT IS FURTHER RESOLVED; that the County of Beadle shall request the South Dakota Highway Patrol to enter the County of Beadle with scales adequate to weigh motor vehicles to insure compliance with State Laws pertaining to vehicle weight and with the weight laws established by this resolution.
NOW, THEREFORE, BE IT RESOLVED: That speed limit for trucks on all oil county roads within Beadle County, South Dakota shall be 40 MPH, effective February 15, 2010. Beadle County requests the South Dakota Highway Patrol Officers to enter the County of Beadle to enforce the speed limit of 40 mph for trucks on all Beadle County oil roads.
IT IS FURTHER RESOLVED; that this resolution be effective each and every year hereafter unless repealed or modified by duly enacted resolution.
