PROCEEDINGS OF THE BEADLE COUNTY COMMISSION
FEBRUARY 9, 2010
The Board of Beadle County Commissioners met on Tuesday, February 9, 2010 at 9:00 a.m. with members present: Chair Werner, Vice Chair Drake, Mattke and Benson. Absent was Marcus.
The Minutes of January 28, 2010 were approved.
Jerry Batien, Beadle County Highway Superintendent met with the Board and showed to them a Power Point program which explained the condition of the bridges in Beadle County, and how much money it would take to fix just the bridges.
Moved by Drake, seconded by Benson, motion carried to adopt the following resolutions:
RESOLUTION 02-01a-10
“FEDERAL AID BRIDGE REPLACEMENT OR REHABILITATION PROGRAM
RESOLUTION FOR COUNTY AND URBAN PROJECTS”
WHEREAS, the Beadle County Board of County Commissioners desires the replacement of the bridge as hereinafter described:
STRUCTURE NUMBER AND LOCATION: Bridge #03-0555-280.8 west and 4.5 miles south of Virgil
AND WHEREAS, Beadle County is obligated and hereby agrees to provide proper maintenance as required by the Federal Highway Act as amended and supplemented thereto for project after construction is completed and to regulate or cause to be regulated the installation of utility facilities within the limits of the right-of-way of the proposed project in accordance with State and Federal requirements.
AND WHEREAS, Beadle County is obligated and hereby agrees to reimburse the State for all costs not reimbursable with Bridge Replacement Funds.
AND WHEREAS, the bridge is in need or replacement/rehabilitation for the following reasons:
1. The sufficiency rating is 31.9 .
2. The bridge is ______ or is not X located on a County or Township designated Minimum Maintenance Road.
3. The bridge is located on a Federal Aid Route , a school bus route X , a mail route X , a field to farm to market route , a lake or recreation access route , or other (please specify) County Highway .
4. The load carrying capacity of the existing bridge can or cannot X be improved to carry legal loads by rehabilitation of the existing bridge.
NOW, THEREFORE, BE IT RESOLVED: That the South Dakota Department of Transportation be and hereby is authorized and requested to program for construction, in accordance with the approved “Secondary Road Plan” and the State’s “Standard Specifications for Roads and Bridges,” the bridge replacement or rehabilitation project at the above described location. Items to be handled by State forces with Federal Participation will include hydraulic study review, foundations investigation (if necessary), plan reviews, and construction administration.
Estimated Cost of Project Including Engineering: $ 300,000.00
Federal Share (80%) $ 240,000.00
Local Share (20%) $ 60,000.00
Proposed Year of Construction: 2018

STRUCTURE NUMBER AND LOCATION: Bridge #03-271-040 14 miles North and 3.1 miles East of Huron
AND WHEREAS, Beadle County is obligated and hereby agrees to provide proper maintenance as required by the Federal Highway Act as amended and supplemented thereto for project after construction is completed and to regulate or cause to be regulated the installation of utility facilities within the limits of the right-of-way of the proposed project in accordance with State and Federal requirements.
AND WHEREAS, Beadle County is obligated and hereby agrees to reimburse the State for all costs not reimbursable with Bridge Replacement Funds.

AND WHEREAS, Beadle County is obligated and hereby agrees to provide proper maintenance as required by the Federal Highway Act as amended and supplemented thereto for project after construction is completed and to regulate or cause to be regulated the installation of utility facilities within the limits of the right-of-way of the proposed project in accordance with State and Federal requirements.
AND WHEREAS, Beadle County is obligated and hereby agrees to reimburse the State for all costs not reimbursable with Bridge Replacement Funds.
AND WHEREAS, the bridge is in need or replacement/rehabilitation for the following reasons:
1. The sufficiency rating is 52.9 .
2. The bridge is ______ or is not X located on a County or Township designated Minimum Maintenance Road.
3. The bridge is located on a Federal Aid Route 6189 , a school bus route X , a mail route X , a field to farm to market route , a lake or recreation access route , or other (please specify) County Highway .
4. The load carrying capacity of the existing bridge can or cannot X be improved to carry legal loads by rehabilitation of the existing bridge.

Moved by Benson, seconded by Drake, motion carried to go into Executive Session for personnel matters at 10:00 a.m. Chair Werner declared Executive Session over at 10:05 a.m.
The Department Heads met with the Board to go over what information to present at the Annual Township meeting, and they went over the 2009 end year actual numbers and discussed what needs to be done for the 2011 budget year.
Moved by Drake, seconded by Benson, motion carried to go into Executive Session for personnel matters at 12:05 p.m. Chair Werner declared Executive Session over at 1:30 p.m.
Moved by Benson, seconded by Mattke, to approve Mike Moore to write a letter to Paul Aylward at AFCSME stating the 3 items that the Board of Commissioners are asking the Union members agree to.
Moved by Drake, seconded by Mattke, motion carried to accept with regret the resignation, due to heath reason, of Tom Beerman, Beadle County Sheriff, effective February 28, 2010. The Board of Commissioners would like to wish him the best and thank him for his 24 years of service.
Moved by Benson, seconded by Drake, motion carried to go into Executive Session for personnel matters at 2:10 p.m. Chair Werner declared Executive Session over at 3:05 p.m.
Moved by Mattke, seconded by Benson, motion carried to appoint Chief Deputy Doug Solem as Beadle County Sheriff effective March 1, 2010 with a salary of $55,000.00.
Moved by Drake, seconded by Mattke, motion carried to approve Juvenile Detention Center agreement with Hand County effective January 1, 2010 to December 31, 2010.
Moved by Mattke, seconded by Benson, motion carried to approve Tom Moeding, Beadle County Emergency Management Director to attend Regional Meeting on February 25, 2010 in Aberdeen, SD.
Moved by Mattke, seconded by Drake, motion carried to accept agreement with Craig Gross on Taxes due in 2002 payable 2003, Rec #13579 legally described as follows: 2nd Athletic Park addition, Block 9 Huron Mobile Estates E44, in the amount of $214.00, and drop the judgment against said property.
Moved by Drake, seconded by Mattke, motion carried to lock in 100% of Beadle County Winter 2010-2011 rate with Northwestern Energy at .766 therm basis, including delivery charges..
The Board of Beadle County Commissioners met with the employees of the County to inform them on where the county ended up in 2009, and what steps need to be taken in 2010/2011.
Moved by Benson, seconded by Mattke, motion carried to authorize Chair Werner to sign a letter in support of HB #1265 (An Act to revise certain provisions related to indigent counsel).
Moved by Benson, seconded by Drake, motion carried to authorize Auditor Jill Hanson to sign a letter in support of SB #184 (An Act to revise certain provisions concerning the taxes imposed by water development districts and the addition and withdrawal of territory for water development districts).on behalf of the Commissioners.
