Beadle County Commission Minutes:

PROCEEDINGS OF THE BEADLE COUNTY COMMISSION
MARCH 16, 2010

The Board of Beadle County Commissioners met on Tuesday, March 16, 2010 at 9:00 a.m. with members present: Chair Werner, Vice Chair Drake, Marcus, Mattke and Benson.
The Minutes of March 9, 2010 were approved as read.
Moved by Benson, seconded by Drake, motion carried to approve Chair Werner to sign an Amended Lease Agreement with between Beadle County Highway Department and Todd and Gail Williams.
Jerry Batien, Beadle County Highway Superintendent informed the Board along with the Huron School Bus Coordinator the County roads that are closed due to flooding. The Commissioners ask that if Townships have roads that are closed because of flooding that they let the Highway Superintendent know. 
At 9:30 a.m., Chair Werner declared bidding closed and the notice to bidder for Rental of Miscellaneous Road Equipment was read. The following bids received:
1) Hollaway Construction Co., Inc. – Mitchell, SD.
2) Darrell’s Rock Sand & Gravel, Inc. – Wessington Springs, SD.
3) Olson Construction – Huron, SD.
4) Standing Elk Construction – Highmore, SD.
5) Odland Gravel – Redfield, SD.
6) Butler Machinery Company – Sioux Falls, SD.
7) Dakota Trucking Inc – Wessington Springs, SD.
8) Beckler Construction – Redfield, SD.
Moved by Marcus, seconded by Drake, motion carried to accept and file all bids submitted as being in the best interest of Beadle county pending they provide proof of Liability and Workman’s Compensation Insurance.
Moved by Marcus, seconded by Mattke, motion carried to adopt the following resolution:
Resolution 03-06-10
RESOLUTION FOR DECLARATION OF EMERGENCY/DISASTER
WHEREAS, Beadle County, South Dakota, has suffered sever damage, brought on by Flooding caused by rapid thawing due to rain the week of March 8, 2010.
WHEREAS, Beadle County has committed all available resources and taken all possible actions within the jurisdictional boundaries to combat and to alleviate the emergency/disaster, local resources are not adequate to cope with the situation.
NOW, THEREFORE, BE IT RESOLVED: by the Beadle County Commission at a regular meting held on March 16, 2010, it is hereby requested that the Governor declare an emergency/disaster to exist in the County of Beadle.
Moved by Benson, seconded by Drake, motion carried to accept Bridge Quote from Hollaway Construction Co. Inc. to repair the bridge #202 between 394th and 396th Avenue in the amount of $24,982.00
Moved by Drake, seconded by Mattke, motion carried to approve the Variance request of SD Wheat Growers, Yale SD to purchase property to build a grain bin within 1 foot of the East side of the 40 x 100 pole building that belongs to Randy Ziegeldorf.
Moved by Drake, seconded by Marcus, motion carried to adopt the following resolution:
RESOLUTION 03-04-10
“PLAT OF PEARL VIEW SEEDS LOT 2, A PART OF THE SE ¼ OF SECTION 17, TWP. 109 NORTH, RGE. 60 WEST OF THE 5TH P.M. BEADLE COUNTY, SOUTH DAKOTA.”
On recommendation of the Beadle County Planning Commission: BE IT RESOLVED: by the Board of Beadle County Commissioners that the plat of Pearl View Seeds Lot 2, a part of the Southeast Quarter (SE ¼) of Section Seventeen (S. 17), Township One Hundred Nine North (T. 109 N.), Range Sixty West (R. 60 W.) of the Fifth Principal Meridian (5 th P.M.), Beadle County, South Dakota as described above and drawn hereon be approved and accepted and the Auditor hereby is instructed to endorse on such plat a copy of this resolution and to certify the same.

On recommendation of the Beadle County Planning Commission: BE IT RESOLVED: by the Board of Beadle County Commissioners that the plat of Pearl View Seeds Lot 3, a REPLAT OF Pearl View Seeds Lots 1 and 2, a part of the Southeast Quarter (SE ¼) of Section Seventeen (S. 17), Township One Hundred Nine North (T. 109 N.), Range Sixty West (R. 60 W.) of the Fifth Principal Meridian (5 th P.M.), Beadle County, South Dakota as described above and drawn hereon be approved and accepted and the Auditor hereby is instructed to endorse on such plat a copy of this resolution and to certify the same.
Moved by Drake, seconded by Benson, motion carried to approve Conditional Use Permit of Jesse Green to sell fireworks at 39650 US Highway 14. Property is owned by Wayne Yauney and legal description is E ½ of SE ¼ of SE ¼ of SW ¼ less exceptions 33-111-62.
Moved by Marcus, seconded by Drake, motion carried to approve the contract between Faulk and Beadle County for JDC Agreement effective March 1, 2010 until December 31, 2010
Moved by Benson, seconded by Marcus, motion carried to acknowledge that Larry Neuharth, Beadle County Weed Supervisor and Stan Dubro, Beadle County Weed Board member attend the annual Weed Convention in Rapid City
At 11:00 a.m., the Beadle County Land Sale was held.
At 11:45 a.m., Chair Werner opened Public Hearing and read Notice to Public Hearing for Amendment of Beadle County Wheel Tax Ordinance.
The Commissioners showed a Power Point Presentation to those in attendance. After showing the presentations, Chair Werner asked for comments.
Township Supervisors asked if the Wheel Tax passes will any of the money be given to the Towns or Townships. Chair Werner said the Commissioners would consider giving 10% of the new $2.00 wheel tax, based on the number of maintained miles to the Township, providing the Wheel Tax passes.
Questions were also asked if the Commissioners have ever considered different ways to save money including looking into grants, freezing buying equipment and contracting out services. The Commissioners informed them that there really are not any grants out there, for road and bridges and that they have already frozen all departments from buying any equipment and already contracted out services.
Chair Werner asked if there were any more questions or comments. Since no more questions or comments were asked, Chair Werner closed the hearing at 1:00 p.m., and announced that the 2nd hearing will be March 23, 2010 at 11:00 a.m.

Moved by Benson, seconded by Drake, motion carried to go into Executive Session at 1:10 p.m. for personnel matters. Chair Werner declared Executive Session over at 1:20 p.m.
