PROCEEDINGS OF THE BEADLE COUNTY DRAINAGE BOARD
MAY 18, 2010
The Beadle Board of Drainage met on Tuesday, May 18, 2010 at 10:05 a.m. with members present: Chair Werner, Vice Chair Drake, Mattke and Benson. Absent was Marcus. Also present was Deputy States' Attorney Jeff Banks.
Chair Werner declared time for Public Hearing on Drainage issue in NW 14/ 6-110-60 (Richland Township)
Testimony was received from Doug Eckmann, Brian Eckmann, Marvin Kelley, Willard Wallman, Tim Meyer and Rick Eckmann, Richland Township Supervisor.
Moved by Benson, seconded by Drake, motion carried to have the culvert looked at by an Engineer, with all effected parties present when the Engineer is looking at the property. If the Engineer report comes back that the culvert was properly installed then the cost for the engineering is to be paid by the Eckmann's, and if the Engineer report comes back that the culvert needs to be modified or fixed the cost is to be paid for by the landowner.
After further discussion was held, it was moved by Mattke, seconded by Drake, motion carried to table the above motion until after all effected parties go out to view the culvert and see if a mutual agreement can be reached.
Chair Werner closed the Public Hearing at 11:14 a.m. to Re-Convene at 2:00 p.m.
At 12:25 p.m. Marvin Kelley and Doug Eckmann contacted the Board via cell phone stating that while all parties were out looking at the culvert, an agreement was reached where Mr. Kelley will install another culvert next to the current one, and that they did not see any reason for them to come back up and meet with the Board at 2:00 p.m.
At 2:00 p.m., the Board convened as Drainage Board.
Moved by Benson, seconded by Mattke, motion carried to rescind the above motion to have the culvert looked at by an Engineer, with all effected parties present when the Engineer is looking at the property. If the Engineer report comes back that the culvert was properly installed then the cost for the engineering is to be paid by the Eckmann's, and if the Engineer report comes back that the culvert needs to be modified or fixed the cost is to be paid for by the landowner.
Chair Werner closed the Drainage issue in Richland Township.
Jerry Batien, Beadle County Highway Superintendent recommended to the Board that the time be extended to May 27, 2010 at 10:00 a.m. for the Doolittle/Chase drainage issue.
Commissioner Benson stated that he had visited with Mr. Doolittle via cell phone asking if had a plan for fixing the drainage damage as per the motion made by the Drainage board on May 10, 2010. Mr. Doolittle stated that he stopped by the Auditor's office last week to get a copy of the Minutes from the Drainage Board, but was told that the Minutes were not approved yet. Mr. Doolittle stated that his plan is to proceed with an injunction.
The Board adjourned to meet next on Thursday, May 27, 2010 at 9:00 a.m.
