Beadle County Commission Minutes:

PROCEEDINGS OF THE BEADLE COUNTY COMMISSION
MAY 18, 2010

The Board of Beadle County Commissioners met on Tuesday, May 18, 2010 at 9:00 a.m. with members present: Chair Werner, Vice Chair Drake, Mattke and Benson. Absent was Marcus.

The Minutes of May 10, 2010, and May 10, 2010 Beadle County Drainage Board were approved as read.

Moved by Drake, seconded by Benson, motion carried to approve to contract Dick Freske, Professional Construction Services/DMM, LLC and Associated Engineers for their professional services in the Energy Block Grant money received in replacing the boiler system in the Courthouse and Regional Correction Center.

Moved by Drake, seconded by Mattke, motion carried to approve the following from Shamrock Colony: Variance Request to construct a confinement feeding operation structure closer to established residences and township road right of way than required setbacks mandate and a Conditional Use Permit to construct an earthen stockpiling area for storing solid manure and bedding from existing turkey barns.

At 10:00 a.m., the board convened as Drainage Board.

The Board Re-convened as Board of Commissioners at 11:15 a.m.

Moved by Benson, seconded by Mattke, to sell to Roy Andersen the property owned by the County, legally described as Lot Four (4) of Wilcox Resubdivision of Lots Eight (8) and Nine (9), Block Twenty-seven (27), Third Railway Addition, City of Huron, Beadle County, South Dakota, for the amount of $1.00, another check made out to the City of Huron for special assessment charges of $2,235.42 and authorize Chair Werner to sign a Purchase Order.

Larry Wattier from NESDCAP met with the board and gave them an update of the services provided to Beadle County by NESDCAP in 2009.

The Board met with Pearl Creek Colony to visit with them on some suggestions as to how the County and the Colony could make the roads around the Pearl Creek Colony better with the limited funds and material available. The Colony stated that the Highway Department is welcome to use any concrete, or rocks that they have. They also stated that they do not have any clay or gravel available. The Board also visited with the Colony regarding their irrigation units, and the Colony said that they could adjust the end guns so that they shut off before it gets to the right-of-ways.

Moved by Benson, seconded by Mattke, motion carried to approve Concrete Contractors out of Brookings to crush approximately 4,500 ton (not to exceed $24,900.00) of asphalt and concrete into two separate products 3”-4” x 1.5” and 1.25” minus at a rate of $5.50 per ton.

Moved by Mattke, seconded by Drake, motion carried to approve the Abatement request for the property address of 778 Arizona Ave SW because of the applicant otherwise qualified for the Assessment Freeze for the Elderly and Disabled, but missed the deadline as prescribed in SDCL 10-6A-4.

At 2:05 p.m., the Board convened as Drainage Board

The Board Re-convened as Board of Commissioners at 2:25 p.m.

Moved by Drake, seconded by Benson, motion carried to approve the 2011 WIC County Contract effective June 1, 2010 through May 31, 2011 and authorize Chair Werner to sign said contract.

Moved by Mattke, seconded by Drake, motion carried to adopt the following resolution:

RESOLUTION 05-03-10

“PLAT OF MILLIKEN OUTLOT 1, A PART OF THE NW ¼ OF 29, TOWNSHIP 110 NORTH, RANGE. 62, WEST OF THE 5TH P.M. BEADLE COUNTY, SOUTH DAKOTA.”

On recommendation of the Beadle County Planning Commission: BE IT RESOLVED: by the Board of Beadle County Commissioners that the plat of Milliken Outlot 1 a part of the Northwest Quarter (NW ¼) of Section Twenty-Nine (S. 29), Township One Hundred Ten North (T. 110 N.), Range Sixty-Two West (R. 62 W.), of the Fifth Principal Meridian (5 th P.M.), Beadle County, South Dakota as described above and drawn hereon be approved and accepted and the Auditor hereby is instructed to endorse on such plat a copy of this resolution and to certify the same.

Moved by Drake, seconded by Benson, motion carried to adopt the following resolution:

RESOLUTION 05-04-10

“PLAT OF BURGSTALER OUTLOT 1, A PART OF THE NE ¼ OF THE NE1/4 OF SECTION 32, TWP 111 NORTH, RGE 60, WEST OF THE 5TH P.M., BEADLE COUNTY, SOUTH DAKOTA

On recommendation of the Beadle County Planning Commission: BE IT

RESOLVED: by the Board of Beadle County Commissioners that the plat of Burgstaler Outlot 1 a part of the Northeast Quarter (NE ¼) of the Northeast Quarter (NE ¼) of Section Thirty-Two (S. 32), Township One Hundred Eleven North (T. 111 N.), Range Sixty West (R. 60 W.) of the Fifth Principal Meridian (5 th P.M.), Beadle County, South Dakota, as described above and drawn hereon be approved and accepted and the Auditor hereby is instructed to endorse on such plat a copy of this resolution and to certify the same.

Moved by Benson, seconded by Drake, motion carried to adopt the following resolution:

RESOLUTION 05-05-10

“PLAT OF Lots 1, 2, 3, 4 AND 5, BLOCK 1 HOSKINS 2ND ADDITION, A PART OF THE SW ¼ OF SECTION 24, TWP 111 N., RGE 64 WEST OF THE 5TH P.M., TOWN OF WOLSEY, BEADLE COUNTY, SOUTH DAKOTA”

On recommendation of the Beadle County Planning Commission: BE IT

RESOLVED; by the Board of Beadle County Commissioners that the plat of

Lots One, Two, Three, Four and Five (L. 1, 2, 3, 4 & 5), Block One (B. 1) Hoskins 2nd Addition, a part of the Southwest Quarter (SW ¼) of Section Twenty-Four (S. 24), Township One Hundred Eleven North (T. 111 N.), Range Sixty-Four West (R. 64 W.) of the Fifth Principal Meridian (5th P.M.),Town of Wolsey, Beadle County, South Dakota, as described above and drawn hereon be approved and accepted and the Auditor hereby is instructed to endorse on such plat a copy of this resolution and to certify the same.

Moved by Drake, seconded by Mattke, motion carried to go into Executive Session for personnel matters at 2:55 p.m. Chair Werner declared Executive Session over at 3:45 p.m.

The Board adjourned to meet next on Thursday, May 27, 2010 at 9:00 a.m.
